Funds are needed for the the Legal support that is required to uphold the published case law of the Valadez case, the Wisconsin Appellate Court Orders, the Wisconsin Statutes for Protection of Domestic Abuse Victims (Wis. Stat. 767.41(2)(d) & 767.41(5)(bm) and to protect this mom and her children putting an end to their unlawful concealment from her against their will and against the law and appellate order.
Working to not give up hope for justice and would sincerely appreciate support to see positive change as this mom continues to work to see the case law on the domestic abuse statutes in Wisconsin in actions affecting the family upheld.
As a result of the law and even an Appellate Order not being complied with, the children are now completely concealed from their fit stay at home mother despite a Wisconsin Appellate Order reversing the father's custody completely and stating, "make Julie’s safety and that of her children a paramount concern in determining placement."
The case is being prepared for an Appellate Writ at this time as the lower court, after now it's 5th reversal and the substitution to a third judge, has only shown they still refuse to comply with the jurisdiction of the controlling order in the Wisconsin Appellate Order 2020AP1006 issued December 29, 2021 as published case law.
In order for this mom and her children to be safe as adjudged victims of domestic abuse they have been instructed that legal representation is needed in number of jurisdictions and the funds will be used for those legal services.
Now is an important time in the case for this mother and her children as well as what this case law means to all domestic abuse victims in Wisconsin. (See WI End Abuse Article here)
The Appellate Order was won setting case law on December 29, 2021 with the hard work of national organization DV LEAP (Domestic Violence Legal Empowerment Appellate Project). Despite it being controlling case law in the state, this mother and her children are still waiting for the relief to be applied to its own case. (See Wisconsin Bar Family Law Article on what this case means to understanding the affects of domestic abuse on children.)
Attorney Michael Bassett has worked previously with DV LEAP and has now taken this case to have the Appellate Order won by DV LEAP now upheld and applied.
Michael opened his law practice upon passing the bar in 2005, and quickly established himself as a nationwide leader in the representation of survivors of domestic violence in custody and domestic relations matters. Michael has presented at several national conferences, including the Battered Mothers’ Custody Conference and the Institute on Violence, Abuse and Trauma. Additionally, from 2011 to 2013, Michael was a staff attorney for the Domestic Violence Legal Empowerment and Appeals Project (DVLEAP.) Michael has appeared in courts throughout the state of Ohio, and has worked with clients in more than thirteen states.
Please support this important work, your generosity is greatly appreciated at this critical time.
