Our good friend Fabian was arrested at the Dolores hill bomb on July 9th.
Fabian was coming to the aid of a group of women that were peeing on the sidewalk of Cumberland st, right by Dolores park. The women in question were approached by a man who came out of a house and started to verbally harass them. This called them a disgrace, among other things, and told them that they couldn’t be peeing on the sidewalk (Public urination is legal in San Francisco). The older man approached and stood very close to several younger women while they had their pants down, and was yelled at by another woman to back up while they finished peeing and then they would leave. The older man started pushing this woman after she yelled at him to give the group of women with their pants down space. When she pushed back, he punched her twice in the face. Another young woman came to her aid and was Pushed. These two women fled to the safety of their group of friends. When Fabian heard what happened, he immediately walked over to the man and confronted him about attacking the women. The man got aggressive and started shoving Fabian, who pushed back. The man then shoving Fabian and became aggressive, and Fabian hit back. After this, the altercation came to a close.
The other men in the house called the police, and pointed out Fabian in the crowd still at the Dolores hill bomb. Fabian was grabbed by police from behind without warning, tackled, and maced. When the young woman who was struck by the older man saw this, she went to tell the police that she was attacked by the older man and that Fabian was only trying to defend her. The police then detained her for 30 minutes. They did not detain, question, or even talk to the older man.
While the young woman was released after being detained for 30 minutes, Fabian was brought to jail. His bail is set at $50,000, and is currently being charged with resisting arrest, endangerment to the elderly, and battery.
He is a Bay Area native and unfortunately does not have the funds to fight these charges on his own, and we all know that the American justice system is more lenient towards those that can afford it.
The Dolores hill bomb is an unsanctioned event, one that is integral to the skateboarding and bmx community in San Francisco.
It is likely that the police were looking for any excuse to make arrests in an attempt to suppress the event, and exhibited excessive force given the circumstances.
This is a clear example of police using excessive force. They ignored the people that were physically attacked and did nothing to try and hold the older man accountable for his violent actions.
