Justice for Plant Medicine Practitioners

On November 2nd, 2021, on a quiet forested mountain in North Carolina, we experienced the unimaginable: our peaceful home temple was raided by six armed and uniformed agents of federal and local law enforcement.

Why was our home turned upside down, our medicine bags emptied, our altars defaced, and all of our savings stolen, while we stood by helplessly handcuffed and unable to protect our sacred space?

A package addressed to our home had been confiscated at customs, purportedly containing three small bottles of ayahuasca.

In a rapidly evolving political and cultural atmosphere where plant medicines are making headlines as powerful therapeutic allies and already decriminalized in several states, federal officials at the U.S. Attorney's office refused to press charges related to this controversial payload – however, the local police in our rural mountain county chose to move forward with a raid, despite the fact that there were no background checks conducted, no evidence collected, and no investigation made into possible conflicts with free exercise of speech or religion.

To make matters even more absurd, due to technicalities in North Carolina state law, the plant substance confiscated in the three small bottles was classified as pure DMT, resulting in a calculation of “doses” and “street value” completely incongruous with reality. Several weeks later, without trial, conviction, or even probable cause, our mugshots were published in a local paper with triumphant headlines celebrating local cops for taking “$500,000 worth of dangerous drugs off the streets”.

As of now, we are each facing multiple felony charges and up to 20 years in prison on state charges for possession with intent to distribute a Schedule I substance (DMT), despite the fact that no history or intent of distribution has ever been established. And, despite the fact that dimethyltryptamine (DMT) is produced naturally not only in a vast percentage of the plant kingdom, but also within our very own brains.

WHY WE NEED YOUR HELP:

Our names are Tayel and Siena, and we are committed students of ancestral wisdom traditions and the path of buddhadharma, in service to freedom for all beings. We have dedicated the last 14 years of our lives to a spiritual path on which master plants are some of our most important teachers. We deeply believe that our respectful, sincere communion with plant sacraments is exactly the type of religious practice that the First Amendment was intended to protect.

Our encounter with the law, challenging and confusing though it has been, is also a tremendous opportunity.

North Carolina is one of a handful of states which have not yet established legal precedent regarding the religious use of entheogens. The outcome of our case will likely affect the rights of thousands of entheogen-based practitioners across this country and influence the legal landscape for generations to come.

We are already 2 years into the process of navigating the courtroom – we’ve gone through several different lawyers and even represented ourselves for a time on our quest to most accurately and effectively communicate our truth. Yet despite our attempts to be independent, self-sufficient, and safely cloaked in anonymity, years in the legal maze have humbled us profoundly: we realize we can’t do this alone.

Now, to move forward, we need your support – support that reaches beyond our local community networks, and into the vast web of resonant-hearted practitioners worldwide.

We are committed in our integrity as spiritual beings to speak and stand in our truth – no easy task in a legal system that would much more readily accept a “guilty” plea. Taking a stance for religious freedom is a multi-year process involving numerous court visits, multiple lawyers, consultation with experts, and many hours of legal research.

Time, patience, determination, and extensive financial investment are essential to our triumphant outcome – an outcome that, we pray, will serve the benefit of all.

Our first goal is to cover costs already incurred ($55k+) and additional funds required to resolve this case at the state level – we are presently preparing for a jury trial, arranging expert witnesses, and coordinating travel of all involved parties. (Total Estimate: $75,000)

Our second goal is to raise the funds required to file and successfully litigate a federal lawsuit against the government parties responsible for violation of state, federal, and constitutional law – this will potentially include the federal agents involved, per the Religious Freedom and Restoration Act and the U.S. Supreme Court's decision in Tanzin v. Tanvir 141 S.Ct. 486 (2020), and the sheriff's officers and the county, under Section 1983 and Monell. (Estimate: an additional $75,000)

At this time we are setting our goal at $150k, to cover costs incurred, and projected costs to resolve our NC State case and fully file and litigate a Federal Suit in defense of our First Amendment rights. Our sincere hope is that this case will be RESOLVED with a JUST OUTCOME without the need for appeals. However, in the case of a guilty verdict, we WILL APPEAL to the level of NC State Supreme Court and beyond, to the best of our ability, which may necessitate additional fundraising.

JUSTICIA PARA CAMINANTES DEL CAMINO ROJO

El 2 de noviembre de 2021, en una montaña tranquila y verde de Carolina del Norte, vivimos lo inimaginable: nuestro pacífico hogar-templo fue allanado por seis agentes armados y uniformados de la policia.

¿Por qué nuestro hogar fue puesto patas arriba, nuestras mochilas vaciadas, nuestros altares profanados y todos nuestros ahorros robados, mientras nosotros estábamos indefensos, esposados y sin poder proteger nuestro espacio sagrado?

Un paquete dirigido a nuestro hogar fue confiscado en la aduana, supuestamente conteniendo tres pequeñas botellas de ayahuasca.

En un ambiente político y cultural en rápida evolución donde las medicinas ancestrales están acaparando titulares como poderosos aliados terapéuticos y ya han sido despenalizados en varios partes del mundo, los funcionarios federales de la oficina del Fiscal de los Estados Unidos se negaron a presentar cargos relacionados con este polémico envío; sin embargo, la policía local en nuestro condado rural decidió proceder con un allanamiento, a pesar de que no se realizaron verificaciones de antecedentes, no se recopiló evidencia y no se realizó ninguna investigación sobre posibles conflictos con la libertad de expresión o del ejercicio libre de la religión, protegidos por la Constitución de los Estados Unidos.

Para empeorar las cosas aún más, debido a tecnicismos en la ley del Estado de Carolina del Norte, la sustancia vegetal confiscada en las tres pequeñas botellas fue clasificada como dimetiltriptamina puro (DMT), lo que resultó en un cálculo de "dosis" y "valor callejero" completamente incongruente con la realidad. Varias semanas después, sin juicio, condena, ni causa probable, nuestras fotografías fueron publicadas en un periódico local con titulares triunfales celebrando a la policía por sacar "drogas peligrosas de las calles, con valor de $500,000 USD".

Hasta el momento, cada una de nosotras enfrenta múltiples cargos graves y hasta 20 años encarceladas en cargos estatales por “posesión con la intención de distribuir una sustancia de Clase I (DMT)”, a pesar de que nunca se ha establecido ningún historial o intención de distribución. Y, a pesar de que la dimetiltriptamina (DMT) se produce de forma natural no solo en la mayoría del reino vegetal, sino también dentro de nuestros propios cerebros humanos.

POR QUÉ NECESITAMOS TU AYUDA:

Nuestros nombres son Tayel y Siena, y somos estudiantes comprometidos a las tradiciones de sabiduría ancestral y el camino del budadharma, al servicio de la libertad para todos los seres. Hemos dedicado los últimos 14 años de nuestras vidas a un camino espiritual en el que las plantas maestras son algunas de nuestras maestras más importantes.
