This Christmas will forever be unforgettable for our family. Our sister Jessie received the shocking and surprising news she was pregnant December 4th. She had taken two pregnancy test that came back negative in prior months. When Jessie went in for an ultrasound appointment on the 23rd to determine how far along she was, the doctors admitted her the hospital for high blood pressure and concern for the baby. She was unable to go home and talk with family. The doctors told her they would be inducing her labor that day. Stunned, confused, and afraid she couldn't comprehend this life altering circumstance she was in. After hours of unsuccessfully trying to deliver the baby, she had to be moved into surgery for a cesarean birth. Jessica’s daughter was born on Christmas day.
After her appointment in early December because of financial concerns her fiancé and Jessie researched adoption agencies, undecided at the time and emotionally overwhelmed on what to do they assumed there would be more time to consider options. While in the hospital and moving through the motions they agonized over their plan. Pressure to provide decisions they were not ready to make, Jessie and her fiancé regrettable signed adoption papers.
Eight days later she reached out to the adoption agency to see if there was anyway to reverse the adoption.
Jessie wrote a letter to the adoptive parents pleading for the return of her child. They declined the request and are choosing to move forward with the adoption.
She is now pleading with the Court, that the surrender of her daughter be set aside, the adoption process disrupted, and her daughter be returned to her to avoid a lifetime of guilt and regret and to enable her daughter to grow up in a loving home with her biological parents and extended family. While most women have nine or more months to decide and contemplate such a life altering decision, Jessie had one month. One month after experiencing the shocking discovery that she was pregnant in the first place, only to then learn, less than 3 weeks later, that she was full term and being rushed to the hospital to induce labor. She could not possibly have the capability or capacity to make an informed decision regardless of what she was or was not told. Her emotional state and unwarranted pressure to decide without the benefit of time to consider options, coupled with the lack of information, guidance, and counseling, caused her to make a hasty decision, void of any informed consent. How could anyone possibly make an informed decision to give their baby up for adoption within one month’s time? A month filled with emotional trauma, unknown fears, reservations, medical emergencies, ingestion of pain medication, and outside pressure and influences. This is not a matter of a change of heart. This is a matter in which the capacity to consent and make the decision in the first place was non-existent. It would be a travesty to deny the return of her daughter under these circumstances.
