I was sued for defamation by a company that doesn't exist.

It took 9 months of court proceedings for the case to eventually be thrown out at Dundee Sheriff Court. We were not awarded expenses as the Sheriff stated that they couldn't enforce an order against a none existing entity. Due to the actions of the individuals behind instructing this action (we don't have confirmation of who they are as of yet, and are looking into whether we can find out through their original solicitors as they presumably had to have completed AML and KYC checks), we have been left with over £22,000 in legal fees. These fees racked up due to paperwork, drafting arguments, and constant delays, withdrawals of solicitors, and hearings being pushed back. In any case, the none existing entity was stated to be overseas, and we believe the individual/s behind this are as well, making it very difficult to pursue further action for costs.

We did start a GoFundMe earlier this year when the action was raised and we received £638 to help us get started in defending ourselves. We have deducted that amount from the overall costs before making this GoFundMe.

I don't expect help, but a few people on my TikTok have recommended making a GoFundMe given the circumstances - so I guess it's worth a shot. In the unlikely even that we exceed our goal, we will be donating any excess amount to Victim Support Scotland. We know full well the stress and upset that comes from an action like this, so would be donating to this charity to help support others who are struggling through the court process.
