Judicial Review of Non-Scheme Medical Training

We are a grassroots committee of NSATs (Non-Scheme Anaesthesiology Trainees) representing our colleagues on the parallel training pathway and campaigning to be recognised for the award of CSCST (Certificate of Satisfactory Completion of Specialist Training). About 60% of Anaesthesiology trainees in Ireland are excluded from formal training and are considered ineligible for CSCST. Trainees in other medical specialties are experiencing the same challenges.

In September 2022 Dr Ahmed Abdelaatti applied for judicial review of this exclusion from recognised training and CSCST under the National Doctors Training and Planning (NDTP) strategy and the training bodies. A judicial review is a court proceeding in which a judge reviews the lawfulness of decisions made by public bodies and advises the Oireachtas (Irish Parliament) accordingly. A High Court judge will consider whether non-scheme doctors are subject to unlawful discrimination. The application had to be made by a named individual because the legal system in Ireland doesn’t support a class action for this case, and there’s a time limit on when a person can apply - to comply with these restrictions Dr Abdelaatti was identified as a suitable applicant. The application has been undertaken with the cooperation of the NSAT Committee and its 190 members across Ireland.

If the judicial review is permitted the costs undertaken by Dr Abdelaatti will be significant - between €40,000 and €50,000. We are seeking donations to support this case in the interest of equality, fairness, and parity of esteem for all medical trainees in Ireland.

Funds raised will be handled by a Dublin based Solicitors on behalf of the Committee.

In the unanticipated event that there are surplus funds, these will be discharged to registered charities in Ireland with international engagement - the Irish Red Cross, UNICEF, Médecins San Frontières (Doctors without Borders), and Human Appeal.
