Larry Burgess grew up in Fredonia, Kansas, located in Wilson County. He has a large, extended family with deep, Kansas roots. He is a husband, father and soon to be grandfather. His first grandbaby is due very, soon. He never planned on living anywhere else, but illness changed his life. Larry Burgess, is a cancer survivor and suffers from Grand Mal seizures that developed after his cancer surgery and treatment. A letter from his doctor to the court stated that Larry never saw any reduction in his seizures from pharmaceuticals. In fact, he had to be weaned off all pharmaceuticals because the side-effects were causing so many health issues, and Larry’s health was in a steep decline due to those side-effects. His doctor also said cannabis was giving him relief. His case started shortly after he went to Colorado to try cannabis. Cannabis is his medicine and has given Larry a new life. Back home, he grew one plant and made oil. He did bring home some vape pens and other products as he searched for what dosage and strain worked to control his seizures. He was allowed to move to Colorado 2 ½ years ago as an act of compassion by his first Kansas judge who granted him a modified bond. He originally had 4 felonies and one misdemeanor. Recently, Wilson County added more charges; 3 1/2 years after the initial charges. Now instead of four felonies, Larry is now facing 18 charges, with 17 felonies. For 2 ½ years he and his family have lived in Colorado. It was a struggle but they made a new life. Yet, there was always a cloud hanging over them. Wilson County refused to dismiss the charges or allow Larry to plead to all misdemeanors. A felony conviction would deprive Larry of his Colorado patient card and endanger his family’s housing situation.
Larry has a court appointed attorney. His attorney will become the new Elk County Attorney in January. Her husband will be the new Wilson County Attorney in January.
Larry is soon to be on his fourth judge and almost as many prosecutors.
The original sheriff in the case has been named in two class action lawsuits.
The latest judge has ordered Larry to move back to Kansas by November 22nd. Further, the judge put Larry under a gag order. The public outcry over Larry’s case has angered the court and they are making Larry pay the price. They accused him of trying to “taint the jury pool.” His medical proof of Covid -19 quarantine did not make it from his court appointed attorney to the court, and he was then accused of, “playing games with the court.” Larry said he could provide the documents from his doctor directly to the court and was denied, and then his modified bond revoked. Larry is being ordered to leave his family and medicine behind in Colorado and face further injustice in Wilson County. And to do it in complete silence.
There are many more legal irregularities with this case that proper representation could fight. His family has started to raise funds to pay for a new attorney. This case operates against the will of the people of Kansas. Many surveys show that over 90% of Americans support medical cannabis as an option for the sick. They do not support putting patients in prison and wasting their tax dollars to prosecute and persecute patients.
