In May of 2021, Officer Ben-Levi utilized his chemical agent to stop an inmate from assaulting him.
Shortly thereafter he was written up for not using a means of egress instead of using his chemical agent.
At the facility level, Officer Ben-Levi chose not to accept days for defending himself and took the matter to Oath.
At Oath the Judge completely vindicated Officer Ben-Levi of his charges and deemed the spray justified.
On September 29, 2022 Officer Ben-Levi was suspended, by the Commissioner, for 30 days as he didn’t accept the findings of the Judge at OATH.
As those of us who have worked with this Officer know, he is always there to assist a fellow Officer and works the 2/3 floor at NIC each and every day. Officer Ben-Levi is an Officer that gives the inmates whatever they are entitled to yet is not afraid to tell them NO.
