McCoy Family : Operation Stay Put!

‌I know that this comes at a time when many families and individuals are struggling out there. Every day there are too many tragedies. I feel your struggle, as I've traversed the rocky road my entire life. This past year has been especially rough, though we keep pushing forward.  Regardless, we just encountered a life changing circumstance, possibly catipolting my family, pets and I, to become homeless. Another family and Veteran thrown to the wayside in exchange for someone else having the opportunity to make a lot of money for themselves... I've never felt this way before, and on top of it, I fear this may fall to the wayside, lost in the noise of it all out there... It's worth a try to swallow my pride and ask for help...

I have a case that involves property litigation, and can't be taken on a contingency basis. I need to put my lawyer on retainer, and fight a battle against deep pocketed people who feel they can just swipe my family and I aside for their own greed. I need help, and for the first time, I am asking for it. Here is my story...




Many of you who know me, know my passion for life. You might also be aware of my talent as a woodworker, and how far I have come the past ten years building from scratch. Ive had all of my belongings stolen and rebuilt twice. Ive moved my shop space numerous times. You may also know go fund me is a little out of my charicter, as Ive always shouldered every setback in life that Ive encountered. Its just life, and I always get through it. But this is different. This is life changing either for the good if I can move forward, or a severe setback if left to my own current economic status.

Some of you may know my family and I recently made a substantial move onto a 10 acre property including a shop with 3 phase power for my woodworking business, and a house to raise my kids with my wife, Brittany. I've been trying to get on that property for over two years. I was patient, but persistent. I offered a lease option with a 3 year term to align ducks and use my CALVET VA loan. The owners agreed! We were ecstatic. We moved in. We felt so stoked and blessed. We felt like we were on the road to winning. We had a plan within our means that would allow us the traction for economic advancement!


If you noticed, I began going to town mowing down the overgrowth, clearing trees and brush, and constructing a greenhouse for our vegi garden. Our vegi garden has already doubled in size since I installed it. The property started taking shape, and the view was breathtaking! We were stoked.....


It turns out that the property owners needed to do a lot line adjustment, so that the appropriate property line was set back atleast 30 feet from the property line. We couldn't sign a lease option without the appropriate adjustments in order, as we would not be grandfathered in, nor could the bank provide financing otherwise. So they had us sign a simple month-to-month agreement, until all checks were in the box. Maybe we were naive, but we had an agreement and proof of it.

Coincidentally, because our property is zoned aggricultural, 5 acres plus, with its own well/ spring water, the property perfectly lends itself to that type of operation, per proposed ordinance, come November when Marijuana becomes legal in the State of California. They stand to make A LOT of money from this. So since we had not signed the dotted line, they gave us a 30 day notice after living here just 6 weeks. Put in a lot of work based on their promise / agreement. Greenhouse materials for our vegetable garden alone were over $750.00. I have about $7,000.00 invested in this property, as it was all-a-go, pending ironing out some issues prior to the lease option signing. 

We were deceived without consideration. What this means is: my shop equipment and business is in limbo, therefore no income; we have to find a new house, and shop, each with separate deposits and moving expenses; we will take a loss on all of our investments on this property without compensation; can no longer bring my disabled dad to caretake him; and severe emotional distress due to our abrupt predicament.

What little money we had to advance ourselves was all for not, and is potentially blown. This is gross injustice! Lawyer says we have a case, under promissory estoppel, or the statute of fraud, but it will be a battle that can take 3-5 years. I choose my battles, and in all honesty, if it were just myself, I would move on. But I am responsible for my family, and I want to fight or my families future.


The property owners are very well-to-do. But they are getting greedy! This Marine may be poor, but I'm HUNGRY! I'm a fighter. If you know me, you know this to be true. Worst case scenario, we need help financially to pivot in a new direction. If we can't raise the money to put my law firm on retainer, we will have to now find a new home and shop. I'll never quit "getting after it".


I am having a hard time swallowing my pride and asking for help, but this is a result outside of my control and wasn't a bonehead maneuver that put me here. It was me trying to take a step in the right direction for my family and the future of my business growth. And it is careless selfishness, and sloppy business practice.

May this be a huge life lesson for us, and by all means, take this as an example: "get it in writing, legally binding!" Promises are only as good as the paper their written on. A man's / woman's word is not enough on its own, sadly... Atleast there are contract laws that are in our favor, if we can afford to pay for their implementation!
