We are raising money for a retainer fee to pay an attorney for my sons case. I have contacted several attorneys and they retained fees have all been around the same amount... $2500.
About a month ago Nathan was running on the playground at school. He wasn’t watching where he was going and he and a little girl collided into one another. There are video cameras at school that proved it was an accident but the little girl fell on impact and when she did she lost several teeth and had a concussion I guess and was taken to the hospital. The school called us and told us what happened and told us that it was a complete accident and that no child was at fault. When Nathan got home we talked about it and helped him work through the guilt he felt for hurting the little girl.
A month later we got an email from an attorney saying that the parents are now suing us. A clip from the email states “we are filing a claim as a result of severe dental and concussion injuries she sustained when Nathan negligently slammed into her as she was walking with friends from the lunch room to the playground. “
I called the school where I was informed that they gave all their insurance information to the family following the accident and they are taking responsibility due to it being on school property and it was an accident.
I then spoke to a civil defense attorney and he said that he doubted they would actually file because in the email their attorney was asking for our homeowners insurance and they basically were probably fishing for a quick settlement.
Then a few days ago I got another email from the families attorney. This is a clip from the email “This matter is not simply going to go away. Should I not hear from either of you in the next 5 business days, or your lawyer, I will immediately file a lawsuit against the two of you and Nathan and proceed towards a jury trial on this matter. This matter does not need to be litigated.”
It was during school hours, the school claimed responsibility. My son did not do it on purpose by any means. He is still shaken up about it.
