Meet the Castle family. Bill and Heather have been married for 24 years next month. They have 2 special needs children: Conner, who is 11, has a condition called ADHD. He is in 6th grade. Kennedi, who is 5 years old, has ASD-- a condition related to Autism, with emphasis on sensory. These children require constant care and availability.
The Castle family has had it's share of bad tidings over the past few years, with situations that were out of their control...
Their home and car were destroyed by a violent storm in June 2014. Many of their belongings were lost or damaged also.
In regards to the current situation, Bill was hurt at work, and suffered a major back side, but Bill kept his composure. He stayed calm until the employer realized he wasn't going to influence him into changing his mind. Bill politely asked if he could leave, and that he would return when he had seen the Doctor. Both the Human Resources Director, and the General Manager said it was fine for Bill to leave.
The workman's compensation insurance company immediately stopped paying Bill that day. As stated above, it was an internal error with the Dr's office-- and Bill should have never been released to go back to work.
Bill saw the Dr about 2 weeks later, and he took an X ray of his fractures.
He explained that Bill should have never been released at all, it was an internal error-- and that the new work duty status letter
would supercede the old one.
Here is where things went bad for Bill-- less than a week after he reported to his employer, he received a certified letter from his employer-- notifying him that his employment had been seperated. HE WAS FIRED because of a Dr's error! The Dr also said that 6 weeks would be the maximum that he could keep him off work conditions under his care. That would take him up to his next appointment.
Bill took the revised and updated work status letter to his employer, hoping that the decision to fire him would be reversed, since the error was not his fault. The manager told him that he "thought this whole thing was done", and "you should have done what the original note said.."
Shortly after delivering the paperwork to his employer, Bill received a letter from the workman's comp company that his benefit checks had ceased.
Bill and Heather then decided together that it was time to seek legal advice.
They hired an attorney, and provided all paperwork and photos they had gathered up to that point. Paperwork was filed to try to get Bill his benefits back from workmans comp. 2 1/2 weeks later, a benefit check for the all of the back payments came in the mail. Bill's next doctors appointment was 2 weeks away at this point. The nurse case manager with the workman's comp company went behind Bill's back, and got a referral to another doctor-- who is specialized in physical assessments related to job injuries. She purposely scheduled the appointment a few days AFTER the first Dr's appointment, so that Bill's benefits would lapse again. Even though Bill got another work duty status, that specifically stated that he was not able to return to work at a light duty level-- he was unable to regain any benefit payments.
May 29, 2015 -- Bill received his last benefit check from workmans comp.
He was sent to physical therapy in Valparaiso, 3 times a week-- for a total of 28 visits. He was also sent to Hammond for a physical assessment and strength test. Bill and Heather tried everything for assistance with the rent and utilities that were quickly becoming beyond past due. The township trustee, catholic charities, the salvation army, and the united way were all contacted.
The township trustee paid the utility bill for June, but she explained that her annual allotted funds were not enough to help them again.
So if you can find it in your heart to help this family through this difficult time. A time of crisis, catastrophe, and despair. This situation could happen to any one of us at any given time.
