On Wednesday, March 27, 2019, I filed a federal lawsuit for copyright infringement in the U.S. District Court for the Eastern District of Texas against defendants Travis Robert McCrea and Francisco Humberto Dias, the latter doing business as “Frantech Solutions.”  The case is styled Van Stry v. McCrea et al., No. 2:19-cv-00104 (E.D. Tex. filed Mar. 27, 2019), and was assigned to Judge Rodney Gilstrap in the Marshal Division.  I filed suit because there were many of my books on McCrea’s eBook.Bike which were available for distribution without my permission.

The complaint can be found here: eroticauthorsguild.org/1-main.pdf

As I said in the earlier statement, litigation is expensive. Very very expensive. I'm currently nineteen thousand plus dollars out of pocket to my attorneys, and that was just to file the case, we haven't even gone to court yet. I expect that will cost significantly more money than I've already spent. Hence why I am asking for your support.

Thank you all.

After talking to a few people and perhaps being schooled a bit on the way the courts work, I am going to retract some of what I said earlier.

While I'm upset over a few things in the ruling, because I thought this ruling would cover those things, it turns out I was wrong and we may still get those things.

Also this turns out to be a lot worse for Mr. McCrea than I thought it was.

I have been going through a rough time the last month, not just because of dealing with this lawsuit. So I do apologize for scaring people. I'm going to talk with my attorney on Monday and we'll see where we are and where we are going.

And again, I want to thank all of you for contributing, your support is the one thing that has remained constant through all of this, and the one thing that has helped me in dealing with it.

Thank you,
-John Van Stry

So, the judge ruled on the lawsuit. Or rather issued a decision that will become a judgement (see link below).

There are reasons why I'm unhappy with this state of affairs, but some of those may just be because I don't understand how the process works (I'm not a lawyer).

Read it for yourself and decide:

Or you can look it up as it's a public ruling.

Hello everyone, here's what's going on:
We have officially served Travis.
Travis did not answer.
Travis is now in default.

Just an update on where things stand.
Travis was served on the 27th. The courts have been notified and all of that stuff.
Now I guess we wait some more. Unfortunately, the legal process is a very slow one. There really isn't anything terribly exciting to share right now.
Thanks all of you for your support, and if anything interesting or of note should take place, I'll notify you.
