Many of you know my husband Jörg Reichert as the famed European restaurateur who brought the one-of-a-kind world food marketplace concepts of Mövenpick, Marché and Marchélino to Toronto, Montreal, Ottawa and Boston. 

When Jörg and I first came to Canada in 1982, Jörg was filled with passion and happiness at the thought of what he could bring to the people of North America. He believed there was a palate for a fresher and newer approach to diverse food, beverage and service offerings. 

Jörg greeted thousands of customers over the years on York Street, the Eaton Centre, BCE Place, York Mills and Bayview, CBC on Front Street, Place Ville Marie in Montreal, Rideau Centre in Ottawa and the Prudential Centre in Boston. Together with Loblaws, Jörg launched fourteen locations of Take Me Marché in Ontario and Quebec. A handshake, a joke and genuine laughter were always on the menu. 

During their heyday, Mövenpick and the Marché restaurants were cultural icons and employed thousands of fine people.  Over the years, Jörg was on fire, alight with passion over the food delights and experiences he could share with his customers and his team. The greatest day of his life was the day we went to China to bring home our two adopted daughters, Olivia Sue and Emma Sue.

But, my friends, the light from within Jörg has tragically dimmed.  In 2007, Jörg suffered a devastating automobile accident in Ontario that resulted in him being declared a ‘catastrophic injury’ victim.  Jörg requires ongoing medical treatment with a team of many therapists and specialists to function on a regular basis. While Jörg has slowly been nurtured back to health, there are permanent injuries; just standing in one place is a challenge, and Jörg’s loss of cognitive and execution skills meant he was unable to work. Our dear Jörg is no longer himself.

The insurance trial still has not been finalized, after almost ten years.  Our settlement from Richtree/Mövenpick did not come through. Our home was seized by financial creditors who, after selling our home at a monumental loss, continue to pursue us in court.  Their goal is to have Jörg’s accident insurance payout be declared as a personal asset.  If this happens, the financial creditors would take a sizeable amount of funds from Jörg’s payout leaving Jörg with whatever little remains. 

We don’t know what the payout will be and when and if it will materialize but we do know that to ensure Jörg’s long term care, treatment and well-being, we cannot let this judgement happen.  The court date with the financial creditors is scheduled for the end of February, 2016 - only a few weeks away.  We are fighting back.  Or at least we are trying to. 

 We need your help to pay for Jörg’s legal defence.  I am trying to protect Jörg’s dignity, and I hope that the hearts of our friends and those we helped in the past will open up for him.  Currently, friends cover our monthly rent and living expenses.

The Swiss have a saying, which is that you know the important things are taken care of when the small details are addressed.  Right now, I am concentrating on the details of taking care of Jörg.  His long term well-being is the big thing that I need your help with.

Any donation you can make is appreciated.  All funds donated will be put towards legal fees to defend Jörg’s security and protection.  If we reach our goal, the surplus funds would be used for Jörg’s long term care requirements and residence.

Dear Friends,

I wanted to provide you with an update on where we stand in our legal cases. We have two. The first is the mortgage litigation where the secondary mortgage issuer is suing Jorg for the value of the second mortgage, after they sold our home for half its market value in 2014.This has been in the appeals process throughout most of this year, with ups and downs. The second legal case relates to Jorg’s car accident and the unresolved claim from the defendant’s insurance company. After nine years, they still have not settled with us.

With the car accident/defendant’s insurance company legal case, we are scheduled for a 7 week trial beginning in 2017. We tried to settle in mediation just recently but the defendant’s insurance company and our excess liability insurer did not come close enough to our requirements to settle. And we have come down a lot from our initial demands just to get this nightmare behind us. There is a pre-trial hearing coming up with a judge, which will be the last opportunity to settle prior to going to court. We have to be prepared to go to trial and we are working on this. It will be a jury trial and six people will sit and decide the outcome.

The mortgage litigation is the legal case that is more pressing. We are in the middle of the appeal process. In August, the mortgage lenders suing us asked the court to lift the automatic stay on the enforcement. If they were successful, the lenders could have appointed a receiver who could get involved into the negotiations in regards to the car accident. The lenders also asked the court to have Jorg pay security costs for the Appeal into court.

We were successful in that the automatic stay was not lifted - which could have led to a disastrous outcome. They of course would only see that they get their money and negotiate accordingly. So thank God, we are safe for now. However, we lost the fight in regards to the security cost payable by November 18th into Court in the amount of $10,000. If we don't pay, the Appeal will be dismissed and an enforcement of 1.2m could start. If we win the Appeal then the $10,000 security would come back to us.

We also have to pay the other side lawyer costs of $4,000. If we don't pay this amount, the lenders will ask for another motion that the Appeal will be dismissed because we did not pay the costs. You can see that we are dealing with an aggressive lender, always pushing the courts to get what they want, irrespective of the fact that our property was sold for half its market value and the current unresolved legal case with the automotive insurance company. They know we are vulnerable and keep pushing for advantage of the situation.

We also have legal bills from our own lawyer in the mortgage litigation.

In total, we need to raise some more funds. Soon. We are open to repaying loans from friends, which will help to bridge the gap up to the point where the car accident case is resolved.

in our legal journey within the Ontario courts. In May, a judgement was made
against Jorg for over one million, with Jorg’s absence from court (because Jorg
had an emotional breakdown at the previous hearing and was ordered by his
doctors not to attend). This judgement never should have taken place without
him being able to defend himself. We will not stand by and let this injustice take
hold. Our new lawyer is very good and he has filed an appeal.
As our trial date is approaching fast in our personal injury tort claim, a mediation
or pre-trial hearing is often the last option to settle out of court. This would be a
much better solution, especially for Jorg who would face a seven-week jury trial.
This would create an enormous stress on his already fragile physical and mental
health.
Until then, we need your help fighting the litigation on the mortgage property, and
the unjust judgement. You will recall that in earlier posts I indicated that the
mortgage litigation had the potential to jeopardize Jorg’s future well being and
needed care if not fought with the assistance of a lawyer.
We have a short window of time during which we need your help to bridge the
gap between the present costs for legal support and the possible mediation or
the outcome of the trial. It looks like legal fees will be another $15k. If there is
anything that you can do to get us closer to this target, we would be very grateful.
There is some urgency to this request. Please email me if you have any
questions about this or ideas about how we could raise these funds short term.
Please believe me that I am not sitting still until this is dealt with and justice has
been done to Jorg.
