PURCHASE OF THE OAKMONT GOLF CLUB
& ADVOCACY FOR RESPONSIBLE GOVERNANCE
This fundraiser is for the purpose of retaining independent legal counsel to represent the interests of the OVA membership and for community education (flyers, publications, etc.) for more responsible and responsive OVA governance. Goals include:
1) Facilitating revision of the OVA governing documents to be in compliance with the Davis-Stirling Act (the California law governing homeowner associations), to mandate a binding membership vote on: 1) major projects with a dollar threshold, 2) projects that will change the character of the OVA and 3) OVA-incurred loans (debt) that exceed a dollar threshold, prior to the BOD taking any such action.
2) Providing media and materials to inform and to prompt the OVA Board of Directors and/or the OVA membership to promote responsible decision making with respect to any OVA issue, including but not limited to the relationship between OVA and OGC, any possible plans to purchase OGC and, should such purchase occur, how the property is to be managed.
3) Providing legal opinions concerning actual or potential actions taken by the OVA Board, staff or membership, and the OGC Board, contracted management company/staff, employees or membership when or where they may impact OVA, including the relationship between OVA and OGC (or similar/equivalent/subsequent entity).
4) Initiating legal action if necessary in order to prevent the OVA Board from committing OVA to purchase OGC without first getting the approval of the OVA membership through a full vote of the community. A legal action may be the only way to prevent Board action that would be a violation of their fiduciary duty to the entire membership and harmful to Oakmont’s future.
