My fight to save Will
Katie, my daughter n law, desperately wanted to protect her unborn baby from the dangerous medication that she was advised was possible the cause for her miscarriage three years prior. Katie has epilepsy. After her first miscarriage, Katie’s mom informed her many children with epelipsy have been helped with cannabis. Katie decided to try it. She was pleased to see her seizure had been reduced from two to three a week to one small seizure a month. Katie was pregnant once again in April 2014. Katie stopped smoking when she found out she was pregnant. Her seizures started back and were more severe. She had to be taken to the hospital by ambulance several times. Her OB/GYN and neurologist advised her she would have to increase her seizure medication. She was very concerned and ask, will the medication hurt the baby. Her doctors advised her they were aware the medications have been associated with birth defects, but her seizure could cause death to her and the baby and she is at high risk of falling and hurting herself and the baby. Having overwhelming concerns Katie researched the seizure medication compared to cannabis. She found epilepsy medication has been known for causing such birth defect as spina bifida, cleft palate, hypospadias, club foot, mental delays and developmental issues. Some of the research Katie found, stated, as much as a 40% increase in birth defect born to mother taking anti seizure medication. She found the studies against marijuana stated, cannabis can cause low birth rate, it may be related to new born irritability, but no known birth defects. The site effects of the cannabis were very mild. When compared to the seizure medication it was clear cannabis was the safest choice. Katie made the difficult decision to start back smoking. She did not have any more seizures through out her pregnacy. She had Will on December 25, 2014. He was perfectly healthy baby boy, 7 pounds 7 ounces. He was truly a gift from God. Without notifying Katie or ask for permission, without any valid reason the hospital conducted a drug screen on Katie and Will. They both tested positive for cannabinoid. Without a warrant, and even though Will had no ill effects, the hospital notified the local authorities , DHR and Sherriff’s department. On January 7, 2015 the sheriff’s department showed up at Katie’s home and arrested her. Only two days after being in Jail and the nurse giving her the seizure medication Katie had a severe seizure and she had to be taken to the hospital by ambulance. We were notified by the Jail nurse, but we were not able to have any contact with her. Katie remainedin jail for seven days, until we could come up with her $7,500 bond. Katie was charged with chemical child endangerment. She could be sent to prison for 1 to 10 years. Katie’s defense is expected to cost $15,000. Katie is on disability and cannot afford this defense. Katie can fight these charges if she receives the proper defense. I am asking for everyone’s support. I'm so sorry for this. I have little to give, but if enough of us chip in, we'll meet the goal. I use a THC free hemp oil for my seizures. They were small, but I had 2-10 a day. Now I have about 2-3 a month. I use a CBD concentrate (6x) from Bluebird-botanicals.com. It has been EXCELLENT, and even gotten my dog's aggressive tumor to shrink 90%. I am saying this because if she says she has found a legal alternative, and can both care for herself & her child while still being legal, then she may avoid many problems. I hope this helps

This is beyond horrific. Where is the common sense and compassion in this system?
Publicize this as much as possible -- people in Alabama (and every other state) need to know how safe and effective medical cannabis is. What's happening to Katie is completely immoral.

Have Katie's attorneys been in contact with the National Advocates for Pregnant Women? They have a ton of expertise on the issue of prenatal substance use and can help identify experts, recruit local attorneys, perhaps get the local ACLU chapter involved.

I wanted to post as anonymous (it won't let me) in order to protect her identity so that she doesn't face the same crazy injustice that is being done to Katie. So i am just posting in my name but will not share her ID with anyone. Here is her story: - Stories like the one you just shared infuriate me and break my heart. The law needs to catch up to science! While I was pregnant, I got severe morning sickness. I lost 25 lbs. The pills the dr prescribed, had possible side effects of congenital heart defects, cleft palette, etc. Shortly after I gave birth, a class action law suit was filed against the makers of that very same drug because babies died, mothers miscarried, and others had serious health issues/birth defects. I turned to my natural medicine because after doing extensive research on both, I felt safer with marijuana. After my father passed away while I was 7 months pregnant, my blood pressure started to skyrocket and panic attacks came back. One puff. Literally. One puff lowered my blood pressure and reduced my anxiety, all of which would've negatively affected the baby. My son was healthy as can be. It is a terrible injustice what they are doing to that poor woman and others like her! And you know what else? With the severe PPD after the baby, weed literally saved my life because I was suicidal and my medicaid was taken away when my son was barely two months. Leaving me without my much needed thyroid medication and also no psychological resources because of no $ or insurance. I suffer from anxiety, depression and ptsd. No one should be prosecuted and humiliated that way over an herb that helps so much. My son is happy, healthy, and always smiling! He is thriving and is actually advanced cognitively (a little behind with teeth lol but he gets that from me). No one should have to go through this or live in fear of prosecution and judgment.

Katie is the mother of my son and I just wanted to tell everyone thank you so much for your support, and update everyone on what is going on now. Although Katie's case has been dismissed, as a part of the dismissal agreement or whatever it may be called (Sorry, I'm not a lawyer) we can't sue the state, the jail, or the hospital even though they infringed on Katie's civil rights, and we have to make an attempt to move out of the state of Alabama. This is a vague request and even though they haven't shown any sign of enforcing this request we were told by another legalization advocate that if we start to try and help other through legalization avocation then they will come after us for not holding up our end of the bargain.
