Second Amendment Litigation:  Help us End Bans of Tasers and Stun Guns in DC and Elsewhere

Arsenal Attorneys™, a national firearms law firm located near Washington, DC, is making this public appeal for support to all Americans concerned with the right to self-defense and the Second Amendment.  On August 2, 2016, Attorney George L. Lyon, Jr  of our firm filed a lawsuit, Wright v. DC, in our Nation’s Capital to overturn the District of Columbia’s complete ban of Tasers, stun guns and similar non-lethal, electronic arms.  This case concerns DC residents, nonresident visitors to DC, and all Americans committed to defending the Second Amendment on every front.  We’re requesting your help in covering the costs of this litigation and similar legal actions in defense of the Second Amendment.

Currently, several states and local jurisdictions ban non-lethal electronic firearms, such as Tasers and stun guns, including:  New York, New Jersey, Hawaii, Rhode Island, the Annapolis and Baltimore area counties in Maryland, New Orleans, Philadelphia, Tacoma and several other cities across America.  Fortunately, the Supreme Court recently overturned a Massachusetts conviction for possession of a stun gun in Caetano v. Massachusetts.  On that basis, we filed Wright v. DC.

Here is an excerpt from one of our court filings:

"The Second Amendment guarantees that “the right of the people to keep and bear Arms, shall not be infringed.”  The Supreme Court has twice affirmed, in Heller and McDonald, that the core of the Second Amendment guarantee is the right to keep and bear arms for purposes of self-defense.  And the Supreme Court has just this term in its per curium decision in Caetano reiterated that the arms protected by the Second Amendment extend beyond firearms to other weapons commonly used by law-abiding persons for self-defense.

"Although the District has reluctantly complied with Heller by allowing individuals to “keep” lethal firearms in their home for self-defense, and has provided a means for public carry of firearms – albeit extremely restricted and constitutional suspect – it continues to deny the Second Amendment right of typical, law-abiding citizens to keep and bear a class of commonly used non-lethal arms inside or outside the home for self-defense:  Tasers and other electronic arms such as stun guns. Heller resolves this case:  The District’s laws preventing citizens from owning and employing Tasers and other electronic weapons for self-defense are flatly unconstitutional and inconsistent with the constitutional right to keep and bear arms for self-defense . . . "

Each of our three plaintiffs exemplifies the importance of the right to keep and bear arms.  The first is Crystal Wright, pictured, an author, blogger, communications consultant and self-described triple minority:  a woman, black and a Republican living in a Democrat dominated city.  The second plaintiff is a nurse who often works late hours.  The third has twice been the victim of armed robberies.  Following the Supreme Court’s decision in Caetano, these plaintiffs have a strong case.  Besides repealing a ban, a successful outcome might include reimbursement of our legal fees and expenses; however, there is a very real risk the reimbursement could be insufficient, or the defendant might take unilateral action to avoid reimbursing our fees and costs. 

We estimate our total legal fees and costs (e.g. expert witnesses, depositions, etc.) could potentially reach a total in the range of $170,000 to $230,000.  Already, we’ve spent 100 hours of time preparing this case, and we expect at least another 70 hours of work just in the next month. Of course a possible appeal could require twice as much time.

If necessary, Arsenal Attorneys™ are prepared to absorb these costs because of our ethical duty to provide pro bono legal services as a public service, particularly in the defense of civil liberties; however, with your help we can reduce our financial risk in this case and increase our ability to  pursue additional legal battles over the right to keep and bear arms.  

Please join us in the fight to defend the civil liberties protected by the Second Amendment.  Your contribution will be held in a trust account specifically allocated for Wright v. DC.  We will withdraw funds from that trust account only to cover fees we have earned and expenses we have incurred.  If we receive reimbursement of this money from another source, then we will return the donated funds to the trust account.  Any remaining funds in that trust account will either be used for other legal action in defense of the Second Amendment or donated to a nonprofit organization dedicated to the right to keep and bear arms.
