mitigate damage done by dental appliance

Hi, my name is Leigh and I'm a victim of damage from an orthodontic appliance and bad treatment by a dentist who didn't do effective follow up xrays, that pushed my top teeth completely out of my alveolar bone, leaving me in danger of losing many teeth without enough bone left for implants and unable to bite into the softest of foods for over a year. The above photo shows how my teeth looked after they were pushed out of the alveolar bone and I started to notice troubling gum recession despite my dentist saying it looked fine.

Here is one of the teeth roots that are tilted out of the bone completely. As you can see, the root of the tooth is sitting in the gums with space between the root and the bone. The braces were still on at this point.


Here is a pan showing how far out the device tilted my top molars out. They were also moved backward, something my dentist told me was "not possible."




The appliance was called AGGA (anterior growth guidance appliance). It is now called ARA, which I think stands for Anterior Remodeling Appliance. There are currently many pending lawsuits filed by patients like me who were damaged by this device.

I chose the treatment because:
  • I was told it would NOT move my teeth (I have photo proof I will post later).
  • I was told it would "grow new bone" to allow my top teeth to grow forward, which could be used instead of surgery for class 3 bites (I was a class 2).
  • My top incisors were retroclined (tilted) back, which was trapping my mandible back, supposedly contributing to TMJD.
  • I was told the inventor of the appliance would be looking at my before CBCT to determine if I was a candidate for the appliance, and that before we finished treatment another CBCT would be performed.

After my initial CBCT, I was told I needed 6-8 mm of "growth." My dentist (NOT an orthodontist) decided to go further than that. I ended up with 10 mm of "growth," and NO follow-up CBCT was performed. When I asked for one, I was told I couldn't get one for a few months because of Covid (this was spring of 2020). So, I decided to go to a 3rd party for a follow-up CBCT. It was then that I saw my top incisors were completely extracted from the alveolar bone.

I sought help from a well-known periodontist, who eventually told me I might want to speak with a lawyer he knew. I worked with that lawyer and subsequently another lawyer he found to help me for nearly 2 years when they decided not to continue pursuing my case because (paraphrasing,): after court fees and expert witness fees, I wouldn't make enough money to recoup my costs. I immediately spoke to two other lawyers, but it was then too late due to the statute of limitations in Ohio.

My initial treatment cost me about $7,000. That was supposed to be all the treatment I needed from start to finish (AGGA and braces).

I did not ask for a refund because I was following legal advice to not speak to the dentist.

I then had to pay $10,500 to a new orthodontist, who helped me get my roots back in bone so that I could have SFOT, which is essentially bone grafting surgery to thicken the bone around my teeth. This is not a surgery I would have needed had it not been for this appliance.

Today I was given the total for SFOT surgery: $18,940.

This makes my total for all this treatment $36,440. That is more than I make in a year as a self-employed small business owner who drives a 15 year old car with 219,000 miles. It's nearly $30,000 over what I originally signed up for. And that total doesn't include all my other expenses, including travel to specialists, time off work, and any final work that might be needed after surgery, such as bonding or crowns or, God forbid, root canals. Follow up treatment will likely cause root resorption, but doing nothing was not an option for me. I have marketplace high deductible insurance and dental insurance, neither of which will cover any of this.

I will add more updates and photos regarding my journey to further illustrate my story. I would so appreciate any help that anyone can give. I paid my second orthodontist the $10,500 using a personal loan and two credit cards. I'm still paying off the personal loan.
