I'm usually one not to burden others with my personal problems or ask for help, but I'm in a desperate situation and stand to lose everything I have. In 2012, I decided to leave my wife of 5 years. Under Utah law, with marriages of short duration, no children and where the spouses made similar money, no alimony is awarded. It should have been a simple matter of filling out one form. The ex-wife decided to get an attorney and try to get as much from me as possible. At the time I was homeless, living in my truck and looking for carpentry work wherever I could find it. Her and her lawyer falsified court documents and claimed I had companies I didn't have and that I was making more money than I was. It appeared I had to get a lawyer. I paid his retainer with the only credit card I had. He then did something completely unexpected... nothing. He failed to answer motions or file the necessary documents. He only answered calls or emails when threatened. His answer was always that he was working on it. He wasn't. The court ended up issuing a default judgement. I then used the last bit of money on my credit card and hired a competent attorney who got the motion set aside but needed another $5000 to finish the case. I was forced to sell my only asset, my truck, to pay her retainer. A week later, the truck was stolen, leaving me with nothing. The Court issued a summary judgement ordering me to pay $500 a month and sell my now non existent truck and give her half. I was completely screwed. After receiving notice of wage garnishment, I discovered a story online written by my ex documenting how she had been reading my personal Facebook messages and how her and her sisters had driven in the middle of the night to the wharehouse I was living in and stole my truck. I was in complete shock. I attempted to use this new evidence to reopen the case. Last Friday I had my day in court and because of the time that has passed, the Judge refused to hear the new evidence. I'm now forced to attempt to modify the existing decree or face losing everything I own and pay $40,000 to an ex and her lawyer who, by all legal statutes and guidelines, should've gotten nothing. I have trouble making ends meet as it is, if forced to pay this, my wife might be out on the streets. As I mentioned previously, I hate to share my personal issues publicly or ask others for help but I'm in my most desperate hour. If you can donate something, anything, I will be eternally grateful.
