MacNearney Family Legal Fee Fallout

Many of you will remember the MacNearney family from Kim MacNearney’s years of work fighting for medical marijuana and legalization. Her passion for activism in this matter, and for helping people with medical needs obtain a medical marijuana licence comes from her own personal experiences dealing with the legal system and medical issues. In 2009, the MacNearney’s were arrested and the family suffered a traumatic event which caused long-term damage in many areas.

In addition to the negative physical and mental affects, the Kim MacNearney’s ability to work was also hindered. Combined with legal fees, cost of replacing and repairing items damaged, and maintaining their household in the aftermath, this left them struggling financially for years. Due to the lasting effects of this financial derailment, the MacNearney family is once again facing a legal battle, with the possibility of losing their home.

For three years during their legal troubles, they were unable to pay the condo fees for their home in Northlands. In 2015 they received a demand letter from the a lawyer for the condo corporation informing them that a lien had been placed on their home, and the condo corporation would be looking to enforce it through court if they didn’t pay the outstanding amount. They spent much of 2015 making payments to the point of causing financial hardship just trying to feed their family. Unfortunately, none of those payments made it to the principle amount owed, but only served to pay off some of the interest being charged each month.

In January 2016, they received another letter from the lawyer for the condo corporation now looking for more than $17,000. The MacNearney’s borrowed money from family and literally pulled their locked pension. They were able to gather enough funds to make the payment at great cost to their financial security. However due to circumstances and procedure, the payment was not accepted and a court date has been set for Friday April 7th, 2017 to put the matter before a judge.

The MacNearney’s retainer for their current lawyer was all used up by the end of March. With no settlement made and a looming court date, their lawyer agreed to continue until the court date, with hopes of resolving the situation without the MacNearney’s being forced to sell their home.

If the offer is not accepted, they may also be forced to pay more legal costs for the condo board and will still have to pay their own as well.

This GoFundMe campaign is meant to provide the MacNearney family with some financial support while they try to deal with the possible loss of their home, and pay for the legal fees associated with this battle. If the goal is surpassed, funds donated will be used to get the family back on track financially and give them some stability. It will help provide for their 4 children’s futures, and to give them a chance to fully heal and move on.
