Im a 36yr old Australian father of 2 children.

My American wife of 10 years separated from me, took my 5 year old Son, had one of the family pets secretly surrendered and euthanized and fled to America.

My son parker was born here in Wagga Wagga, attended local day care, had friends, Grandparents and an uncle nearby, as well as great grandparents in the same state. He has lived here his whole life.

When she left, she left behind myself, My 15 yr old daughter (who she was the mother of for 10 years) and one family pet that i had in my care when she fled.

She gave me my son allowing me a weekend visit to see his sister and his grandparents which she used to pack his and her items from the family house, and secretly surrender the dog Dax. I handed him back as promised at the agreed time. She took him the following morning and text me from an international airplane runway.

As we had just spoken to Australian lawyers, We tried to get him returned under the Haig international law act. We spend 7k, and 2 months going through division 2 and division 1 federal court to find that a loop hole meant while America is part of the Haig, they never rectified the law, Meaning the federal judge is unable to make an order he can enforce in America. Neither my lawyer or hers realized this and as such wasted 2 months of time and money.

As such we are unable to get our money refunded in Australia because Australian lawyers are protected against malpractice and need to apply for the return order in the American federal court system. Im asking for assistance to get the return order needed to force her to bring my son back to be around his sister. I have begged her to return on her own, to which she ignores my emails. I've offered her majority care or to stay in the house we own. Begged her to do it for the young girl she claimed to love in her affidavit yet shows no care that this is affecting her or her brother. There is also a time limit of 12 months, After which they usually say its to traumatic for the child to be relocated again.

I am also petitioning the government for assistance, and my parents have offered to help as well. However this is truly the hail Mary as if we cant secure the return order. I am unable to visit or even be involved in any kind of co parenting relationship for my son.

I very rarely ask for assistance. Ive sold my boat, and tried to get this far without asking for help. But now i must ask, If you are able to spare something to help a father and sister to see a son and brother. I would be grateful.
