UPDATE July 2026

We wanted to share an important update with everyone who has supported Nico and stood by him throughout this journey.

Unfortunately, despite every effort made by his legal team, the immigration judge denied the motion to reopen his case. This leaves Nico with little to no legal options remaining to stop his deportation.

While this is not the outcome we prayed for, we want to sincerely thank every single person who donated, shared his story, sent messages of encouragement, or kept him in their thoughts. Your kindness gave us the opportunity to fight for every chance available, and that means more than we can express.

At the time of writing this update, Nico remains in ICE custody and will continue to be detained until the government carries out his deportation. Although this chapter is coming to an incredibly difficult end, a new one is about to begin.

We are still finalizing the remaining legal expenses related to his case. Once those obligations have been covered, every remaining dollar raised will go directly toward helping Nico rebuild his life from the ground up after his release. After the trauma of detention and the loss of the life he built in the United States, he will be starting over with very very little. Your generosity will help provide him with stability as he navigates housing, basic necessities, employment, and the many challenges that come with beginning again in a country he was forced to leave years ago.

From the bottom of our hearts, thank you for believing in Nico and for giving him a fighting chance. Although we couldn’t change the outcome, your support has reminded him that he is not facing this alone. We remain committed to being transparent with all of you, and we will continue to share updates as they become available.

ACTUALIZACIÓN JULIO 2026

Queremos compartir una actualización importante con todos aquellos que han apoyado a Nico y lo han acompañado a lo largo de este camino. Lamentablemente, a pesar de todos los esfuerzos realizados por su equipo legal, el juez de inmigración denegó la moción para reabrir su caso. Esto deja a Nico con pocas o ninguna opción legal para detener su deportación.

Aunque este no es el resultado que esperábamos y por el que oramos, queremos agradecer sinceramente a cada persona que donó, compartió su historia, envió mensajes de ánimo o lo tuvo presente en sus pensamientos. Su apoyo nos dio la oportunidad de luchar por cada posibilidad existente, y eso significa más de lo que podemos expresar.

Al momento de escribir esta actualización, Nico permanece bajo custodia del ICE y seguirá detenido hasta que el gobierno lleve a cabo su deportación. Aunque este capítulo llega a un final increíblemente difícil, está a punto de comenzar uno nuevo.

Todavía estamos terminando de gestionar los gastos legales pendientes relacionados con su caso. Una vez cubiertas esas obligaciones, cada dólar restante recaudado se destinará directamente a ayudar a Nico a reconstruir su vida desde cero tras su liberación. Después del trauma de la detención y de perder la vida que había construido en Estados Unidos, tendrá que empezar de nuevo con muy pocos recursos. Su generosidad le ayudará a encontrar estabilidad mientras gestiona temas de vivienda, necesidades básicas, empleo y los numerosos desafíos que conlleva volver a empezar en un país que se vio obligado a abandonar hace años.

Nicola’s Story

My friend Nicola Tolosa was detained by ICE and deported after spending years doing everything the right way.

What makes this story so heartbreaking is that Nico was not hiding, evading the system, or ignoring his responsibilities. For over two years, he was actively working through the legal immigration process, trusting the attorney handling his case and repeatedly seeking confirmation that everything was in order. As a result, he experienced legal malpractice during the process.

Then, without warning, he was detained.

Only after Nico's detention did we learn about a court hearing he was never aware of. To the best of our knowledge, he was never informed that he was required to appear, despite remaining in contact about his case and relying on the guidance he was receiving. What should have been a step toward building his future instead led to his deportation.

Nico is an Argentinian trans man, a professional bartender, a creator, and one of the most hardworking and responsible people I know. He has spent years building a life, a community, and a future. He believed that by following the rules and trusting the legal process, he was doing everything required of him.

Today, that future has been thrown into uncertainty.

He is now facing significant legal expenses as he fights to understand what happened, protect his rights, and explore every available option moving forward. The emotional and financial burden of this situation is overwhelming, and he cannot face it alone.

Mi amigo Nicola Tolosa fue detenido por ICE y deportado después de años haciendo todo debidamente.

Lo más desgarrador de esta historia es que Nico no se escondía, ni evadía el sistema, ni ignoraba sus responsabilidades. Durante más de dos años, trabajó activamente en el proceso legal de inmigración, confiando en el abogado que llevaba su caso y solicitando repetidamente confirmación de que todo estaba en orden. Como resultado, sufrió negligencia legal durante el proceso.

Luego, sin previo aviso, fue detenido.

Solo después de la detención de Nico nos enteramos de una vista judicial de la que nunca tuvo conocimiento. De acuerdo con la información disponible, nunca se le informó que debía presentarse ante el tribunal, a pesar de mantenerse en contacto sobre su caso y confiar en la orientación legal que recibía de su abogado. Lo que debería haber sido un paso hacia la construcción de su futuro, en cambio, lo llevó a la deportación.

Nicola es un hombre trans argentino, mixologo profesional, creador y una de las personas más trabajadoras y responsables que conozco. Ha dedicado años a construir una vida, una comunidad y un futuro. Él creía que, al seguir las reglas y confiar en el proceso legal, estaba cumpliendo con todas sus obligaciones.

Hoy, la vida que construyo con tanto esfuerzo esta en peligro.
