Today the Citizens Against Linscott/Interstate Asphalt Plant retained a lawyer to help us in our endeavor to stop the Sagle Asphalt Plant.
His name is Gary Allen, one of the partners at Givens and Pursley, and is one of the writers of the Idaho Land Use Handbook. Mr. Allen has confirmed our argument of nonconforming land use regarding the Linscott property is black and white, as they are not allowed to add to, or expand the property to build an asphalt plant. Moving forward, he would also like to confront the amendment changes presented by the Bonner County Planning department in April and then again to the Bonner County Commissioners in May, which will take more time, but is worth adding to the letter and being part of our argument now for the March 22nd at 9amreconsideration hearing, and if we lose, in the future to be used if we need to take this to a higher court.
He is requesting help from Jonna, the groups organizer, and Darcey, our planning expert, in requesting public records and doing some homework to help him keep the groups cost down and to be more cost effective.
You may want to know what the top lawyers in his field would cost to help us battle this at the reconsideration level? Approximately $4000 to $5000, which will include his time of approx. 10 to 12 hours and a letter laying the aspects which are illegal. As he said, this should stop this moving forward.
If everyone could give to help the cost, then it will not be too expensive on any one person, or family, and it seems only fair to have everyone chip in as much as they can give - to help keep this out of our neighborhood.
Remember this, your property will drop on average 27% within a mile of the asphalt plant, which is most everyone on this list.
Of course, if you are choosing to give, and then not being able to eat your next meal, then please don’t give - and support us with prayers and you can also give possibly in other ways, just ask.
Some can only afford $50, some $500, and some $5000. Please consider helping so it doesn’t be such a burden on a few people.
As of now we are trying to raise $5000 and are praying he will be able to stop them in their tracks.
