I am an approved participant in the innovative sandbox initiative of the Law Society of British Columbia, that provides proponents the ability to provide legal services as non-lawyers in limited scope matters. I practice residential tenancy law.
Hayley Anderson and her mother Valerie Anderson had a very unfortunate set of circumstances occur which has led them to being evicted. The circumstances were beyond their control as such I support this campaign, and have created it with the consent of the Anderson's.
The Anderson's are a mother / daughter duo, who reside together. Valerie Anderson, is terminally ill with Stage 4 cancer, and has been approved for MAID (Medical Assisted Dying). Hayley Anderson, is a persons with disabilities, and supplemented her income through employment until she was wrongfully terminated by a large coffee chain.
In October of 2023, the Anderson's moved into a modular home in Kamloops, BC. at the time of entering into the tenancy with the landlord the Anderson's informed the landlord they were relying on PWD and SAFER, to pay their rent. They requested the landlord to fill out a Shelter Information form, and to provide them with a Residential Tenancy Agreement. This was a legislative requirement for the Ministry of Social Development so that Hayley Anderson could be issued shelter benefits to pay her rent. The landlords failed to provide a properly executed tenancy agreement, as well as a proper shelter information form. Therefore the Ministry could not verify their tenancy. As a result of the landlords failure to provide proper documentation, Hayley was not provided her income assistance disability. Hayley took steps to try to force the landlord to provide the documentation. She attended the Residential Tenancy Tribunal, (RTB) and obtained an order that the landlord provide proper documentation including a proper tenancy agreement. The landlords provided a residential tenancy agreement again containing unverifiable information. Hayley was still not able to access her shelter benefits. Therefore in July of 2024, the landlords issued a 10 - Day notice for non-payment of rent. The landlords further knew that Valerie Anderson, was intending to exercise her rights under MAID, to die in the rental home, which is her legal rights.
The matter went before the RTB in August of 2024, at which time the Arbitrator issued an order of possession to the landlord and refused to understand that the Anderson's could not pay rent due to the actions of the landlord. The matter went for review consideration and the RTB did not accept that either.
The Anderson's filed for an Interim Stay of the eviction on September 3, 2024, and served the landlord on September 4, 2024 their application, and on September 5, 2024 the landlord knowing the matter was before the court retained a court bailiff and enforced a writ of possession. On September 5, 2024, the Anderson's were evicted from the property, at the time of the eviction Valerie Anderson sustained a heart attack and was denied medical attention. Eventually medical personnel did attend. On September 9, 2024, the matter went before the Supreme Court, and Justice Groves, ordered an Interim Stay, and ordered that the Landlords permit the tenants to return to the property and to return all of their belongings. The landlord is in contempt of this order, as the tenants belongings were not all returned and there is substantial items missing, and items that were returned were damaged substantially and broken. (THIS IS CONFIRMED THROUGH WITNESSES, RCMP and VIDEO evidence of before and AFTER). On September 21, 2024 the Judicial Review was heard before Justice Smith, who is a newer judge primarily that conducts criminal cases. Justice Smith upheld the eviction and extended the Interim Stay until December 31, 2024. On August 28, 2024 All Rental Arrears had been paid including September 2024 rent, as the Ministry finally accepted the Anderson's paperwork from the RTB showing there was in actual fact a tenancy.
The landlord knew that Valerie Anderson intended on implementing MAID in the rental unit which would depreciate his property value given that you are required by law to disclose if a death occurs in the property.
This entire situation was beyond the control of the Anderson's they did everything right. Unfortunately the judge did not take into account the material breach by the landlord which led to the non-payment of rent. The matter is under appeal with BC Court of Appeal.
The Campaign:
I have created this fundraiser to help the Anderson's pay for other housing and for moving expenses. Any left over funds will be used to pay for legal expenses for the BC Court of Appeal and donated to the lawyer that takes on their case.
