I need funds to retain an attorney. The new restaurant that opened in my building in September is operating an exhaust fan that is a nuisance. When it is on, during restaurant open hours, my apartment is unlivable.
I currently live and work in my apt. The vibrations and excessive noise from this machine are interfering with my ability to work. A great deal of time is spent seeking amelioration from this machine sitting right above my home on the roof. Yesterday, for instance, it was shaking so vigorously, I thought it was about to fall. This is more of a banging on my ceiling.
This same fan was used by the previous restaurant, and the only reason I finally got relief is because they went out of business. For three years, 24 hrs a day, accumulating three DEP violations, I lived with this fan, and it was a living hell.
This fan NEVER operated without being a nuisance.
I take frequent walks. I have to. When it's not so bad, as it fluctuates in varying degrees as far as noise and vibration out put, I try to ignore it. However after about an hour, I get vertigo. from sitting on my couch. This is like having a helicopter sitting right above me on the roof, for most of the day and evening.
Suggestions have been made on how to improve conditions, yet between successive businesses, and the landlord, nothing has been done.
There are many other unpleasantries that come with this issue, as you may imagine, so yes, I need an attorney. To be clear, this is not a matter of "get some ear plugs" or "a white noise machine".
Even with these, it doesn't help. This is on an enduring basis.
As well, it's not my machine to fix, so I'm not at liberty to take it on myself.
A demonstrated willingness to do nothing by those responsible and who benefit, over years, is evident. I need your support to retain an attorney to help me get relief from this so I can work. It's affecting my health, and my ability to work and earn a living, and sustain my career.
In January 2020 I made the discovery that the exhaust fan is indeed improperly installed, making clear why it has been an (ongoing) nuisance. The NYC Dept of Bldgs issued a functional violation to landlord. ( This is in addition to the two DEP noise violations, which are issued to restaurant which opened sept 2019)
