Help Justice Prevail for Veteran

I am writing on behalf of our friends, Mike, Hilda and Adriana, as they have been facing an inordinate number of unfortunate circumstances (some of which never should have been permitted to occur in the first place!) for sometime now and are in dire need of assistance.

After sustaining flooding damage to their home of more than 40 years in Brooklyn and having had a break-in, both parents had been hospitalized many times for various issues. With no other family members in close proximity, they, as a family unit, decided it would be best to leave Brooklyn (temporarily) until they could decide how to approach gathering their belongings and manage the sale of their home.

After heading out to Long Island--and spending most of the family's life savings on hotels, they found an apartment, which had not come soon enough. The father, a Korean Conflict Veteran, originally had intended to apply for a $0 Down Payment loan for a new home--and to somehow get some rehabilitation help at a VA hospital, but as a result of the flooding, did not have his DD-214 document readily available, so those avenues were temporarily cut-off. The family worked tirelessly to acquire a copy, and it was not until the daughter, who had written to then President Obama, that the family received a copy of the tattered form, albeit 9 months after the search began.


It seemed that that was a little too little too late as the father had taken a fall and ended up in a hospital that had another agenda. For want of a better term, this veteran was essentially held hostage by that hospital until he was deemed "incapacitated" under false pretenses, then drugged until he had suffered a "seizure," which appeared to render him "incapacitated" at least for a time--long enough to permit the petition the hospital set forth for guardianship to be ordered by the judicial system against the family's wishes, and which was known by all parties involved. The father himself made it known to the attorneys that he did not wish to have a guardian, but if that became necessary, he wanted his only child--his daughter--to be appointed his guardian--as one would expect--not some stranger who is not familiar with the family, nor with the father's wishes.

That was only the beginning of the problems that followed. A temporary medical guardian was put in place, so the family was not provided with information on the father's condition. After quite sometime had passed, the father was permitted to go to a local rehab center, even though he was basically immobile as a result of the drugs that were permitted by the guardian with the knowledge that side effects were observed for quite sometime. He had been there for several months with mounting bills (not to mention other hospital bills for surgeries that would not have been required if not for the terrible treatment received--and the life-threatening conditions created at the previous one) that are exorbitant.

It seems that the father will require many months of rehabilitation to increase mobility as a result of the negligence of all those involved. The wife and daughter are by his side every day, helping him to do exercises and trying to keep his morale up--and although the progress is extremely slow, he is making small improvements every day.

At present, all of the family's accounts have been frozen by the judicial process and this has made it impossible for any of the bills that are piling up to be paid. The new guardian has not properly done his job either. He does not inform the family about anything regarding the father's condition, not even when the father was hospitalized with a high fever. The guardian refuses to respond to phone calls, etc. All it seems he is accomplishing is taking over all the accounts as an obvious grab for money on behalf of the lawyers opposing the family's wishes, and the hospital that created this whole mess in the first place.

Although the situation is heartbreaking and an obvious miscarriage of justice--not to mention quite stressful, since the family has been stripped of the right to care for their own family member, at present--even with the capacity and right of doing so, the financial burden has become too difficult to bear without help, especially with legal fees, rent and the possibility of being relocated, not to mention food, clothing and a decent existence for the wife and daughter until the situation is rectified.

In addition, the court has permitted this "stranger" to make life and death decisions on the father's behalf, even though it is counter to what the father and the family wants.... It seems that the hospital that should not exist in the first place was permitted to create all of the father's health issues (almost to the point of death!)--and to add salt to the "wound" is now trying to "legally" strip the family of everything they have....

If help does not come soon, the family could lose their home of more than 40 years, a livelihood-- and all they own in this life--all as a result of the egregious undertakings of a number of mendacious and greedy individuals and a flawed judicial system that most certainly violates the family's human and civil rights, not to mention what amounts to elder abuse, as well....

The family has survived insurmountable odds just to find themselves mired in a legal battle not of their own making. Please help in any way that you can to fight this injustice and reunite this family again!  #Veteran #AirForce # Military #Injustice #ElderAbuse #UnjustLegalSystem
