
Protect Victims, Not Big Insurance
There was a trial to attempt to recover compensation for her lifetime needs and her other harms and losses. The jury was shown that her needs and her harms and losses were in excess of $9 million. The doctor and his insurance company did not contest the amount of the losses.
After hearing all of the evidence, the jury awarded Nancy $35.6 million. Unfortunately, the law in Virginia provided that Nancy could only recover $2.2 million. This Virginia law that puts a cap, or limit, on the amount that a victim of medical malpractice can recover, regardless of the amount of harm suffered by a victim of medical malpractice, is not just. It benefits big and powerful insurance companies at the expense of innocent victims of medical malpractice.
This law needs to be changed.
We are undertaking an effort in Virginia to eliminate the cap on damages that a victim can recover from medical malpractice. This is why we need your help. It will cost a lot of money to stand up against the insurance companies in an attempt to change the law. We need money to mount a public relations campaign. We need to make the legislature understand that the law is unjust and as written does not provide for equal access to justice.
