We are a Christian non-profit worship group that leads youth conferences based out of a church in Houston Texas (now, Jacksonville, Florida). We were donated an incredible Mercedes SPRINTER VAN vehicle (originally purchased from CHALMERS AUTOMOTIVE) by an amazing family, to travel in because renting vehicles was becoming so expensive and unreliable. As we traveled, we found that we could save more money with a vehicle that had a sleeping area setup instead of having to stay in hotel rooms. Also we thought that our churches teams would be able to use the vehicle for free to use as transportation and lodging for conferences and events. As a ministry, every little bit helps! Because of this thought, we decided we should sell the Sprinter Van and use the funds to get a used vehicle/bus/RV we could sleep in.
CHALMERS AUTOMOTIVE offered to buy back our van to sell to a known and ready buyer to purchase. Chalmers came and picked up the Sprinter Van, paid a small partial amount (which is now had had to be used to help get through all of this) and said that they would pay the rest when the buyers picked up the vehicle. Weeks passed, buyer picked up the vehicle but Chalmers never paid us. Chalmers told us that they needed the title to receive the funds, so sadly, not knowing any better, we sent it to them. A week later the vehicle was registered in New Jersey without any mention of when we would be paid. Chalmers still has not paid us despite receiving full funds from the buyer. Chalmers literally took the money and our vehicle and put the funds from our vehicles sale back into their own pockets while lying to us about when we would be paid. We have had to rent vehicles in the meantime costing us over $5,000 dollars and also hire attorneys to try and pursue. Now, we have spent over $31,000 just in attorney fees and court/travel costs (which Peter and his wife had to take out a loan for). I must say though, our incredible attorneys have discounted as much as they could!
After Chalmers filed for bankruptcy this summer, we learned that they have failed to fulfill many orders or deals with similar like people across the country and have numerous law suits against them. (EXAMPLE: pleadings from the courts reveal that a buyer would never see the vehicle which he/she wire transferred money for to purchase) Fox News 4 in Kansas City is already investigating Chalmers for fraud.
As you can imagine, having to pursue CHALMERS in several litigation matters has been very expensive for us. We simply wanted to have the vehicle funds provided to us so we could continue on with our ministry and Help other ministries. But pursuing CHALMERS in Texas and the bankruptcy court in Kansas City, Missouri, to try and retain our rights has put us way beyond our budget and into serious debt. Though we may not have the funds to continue pursuing Chalmers Automotive in state court, especially with no guarantee of ever receiving any funds because they owe the bank and irs first, our efforts and the money we spent did get their bankruptcy dismissed so they can not hurt anyone else!!!
We would be so grateful to you for your help getting us the vehicle we lost and making us whole. Every little bit will help as the first 30k will help pay off the direct debt (rentals, legal fees ect.) we (Peter's wife and himself) have gone into this past year from this and the last 66k will help us to buy a new(used) vehicle to continue doing ministry in! Peter and Ashley recently found out they will have the blessing of their first baby on the way, so your help will mean more than ever at this time!
Also, if by some miracle we receive any kind of settlement (which is unlikely due to the amount they first owe the IRS) we will return 100% of the donated funds!
