Update, the new owners have started the court eviction proceeding for July 5th, the family has to file an answer by July 2nd! They are obviously overwhelmed and anxious, and trying to take this all in. We were all hoping that we could at least get the ball rolling in court with the attroney to file the injunction, to at least try to place a restraining order on their home till the case was heard. We would also have loved to help them with this situaton as it unfolded. When the family bought their first home, they never thought they would have to plan to move again or to have to take their daughter away from the only home she has known! Especially under these circumstances. They did not know that Scott was going to become ill with his heart condition. They also didn’t know for sure that they had been deceived by the loan officer, and those who had a hand in this illegal, wrongful, fraudulent matter, till May 2017, when a very compassionate woman heard their story! Marie did the mortgage analysis out of the kindness of her heart, that proved this, and inspite their on going efforts to reach out to the Attorney Generals office, and all other resources filing complaints for the last 10 years!! Senators office recently stated they can't do anything. This is truly disappointing as they have come so far to just have to give it all up. Although the family has accepted what has already been done, they still have faith & hope and they will not accept that there is nothing more that they can do even at this point! This isn’t just about them. This is being done to so many. We need to have justice. If you cannot donate, they understand, but please share this wherever you can. This struggling mom and dad desperately need help to keep the family home. Their severely disabled, twelve-year-old daughter, Emma, has down syndrome and suffers from extreme anxiety and other medical issues. Mom, Terry, is a full-time stay-at-home mom dedicated to caring for Emma and the rest of her family. Emma’s dad, Scott, has undergone two major heart surgeries and is currently on disability. Scott works part-time to help make ends meet.
In 2006, Scott was working full-time and realized the dream of buying a home. However, Scott and Terry were unsure about the transaction from the start. They didn’t understand the terms of the loan and felt they had been misled. Soon after, in 2007, Scott had heart surgery. A second procedure followed a few years later, and Scott was forced into an early retirement.
Their mortgage loan is being serviced by one of the nation’s five biggest bank. For years, Scott and Terry have tried to obtain a modification without success. Like millions of other Americans, they have been put on the modification merry-go-round and told that their paperwork was lost or incomplete. Now the bank is threatening to foreclose on August 9, 2017, and leave them homeless. Emma, who has trouble adjusting to new environments and situations, will be especially traumatized if she is removed from the only home she has ever known.
Recently, Scott and Terry sought advice from the country’s foremost mortgage fraud analyst, Marie McDonnell. They learned that their initial misgivings about the mortgage transaction were correct. They were fraudulently induced to enter into a highly predatory loan. Ms. McDonnell referred them to an experienced local attorney, and they need funds to hire him to take their case.
