In 2004, at 16 years old, I was wrongfully convicted and sentenced in adult court to Life Without the Possibility of Parole for a crime that occurred in 2003.  I had absolutely no involvement. 

At 16 years old, I was arrested on charges of First Degree Felony-Murder in El Dorado County, California. Besides the alleged 'confessions' of two young men who were guilty of the crime and a handful of their friends, the police had nothing to base their suspicion on. To this day they have even less. There is no factual evidence to substantiate any of their claims. There is not one shred of physical evidence tying me to the crime. I have lost half my life to a crime I had no involvement with due to the misconduct and manipulation of law enforcement and prosecutors.

My family is tirelessly fighting to bring me home. In 2015 The Ninth Circuit Court of Appeals reversed the lower courts’ denial of my appeals and granted me an Evidentiary Hearing stating that "O'Brien's state Habeas petition alleged facts that if accepted as true, showed that trial counsel failed to introduce available evidence that would have significantly strengthened O'Brien's defense. Indeed, if believed, the additional evidence would have rendered it virtually impossible for O'Brien to have committed the murder with which he was charged, given the location of the murder and the state's theory as to when it took place."

In January 2017 my Evidentiary Hearing was held in Sacramento, CA. Yet I am still waiting for the ruling, wasting precious time and resources. We desperately need more support to get my case heard and to bring me home. My habeas corpus petition went before the federal Ninth Circuit Court of Appeals, and the oral arguments hearing was held July 6, 2015. On October 25, 2016, the Ninth Circuit Court issued their ruling ordering an Evidentiary Hearing to be held. In the Ninth Circuit's ruling they stated, "O'Brien's state habeas petition alleged facts that, if accepted as true, showed that trial counsel failed to introduce available evidence that would have significantly strengthened O'Brien's defense. Indeed, if believed, the additional evidence would have rendered it virtually impossible for O'Brien to have committed the murder with which he was charged." and "Competent counsel would not have failed to put such evidence before the jury." Based on this ruling I had hope I may have my rightful freedom restored within months; that I would soon be home.
The Evidentiary Hearing was held January 17-18, 2017; over a year later. My case always seems to be plagued with one delay or another; continuously dragging out the fight for my freedom.
For example, at the conclusion of the Evidentiary Hearing, the Magistrate unexpectedly ordered my lawyers and the Attorney General's office to provide additional briefs. My lawyers did not expect that and told me it's almost unheard of to have additional briefs after an Evidentiary Hearing. Briefs had already been filed BEFORE the hearing. The evidence was produced AT the hearing. The briefs took 9 months to file. There were several extensions requested on filing deadlines; prolonging my wrongful incarceration.

On September 20, 2017, the last brief was filed. We are still waiting for the Magistrate to make her ruling over one year later. I am coming up on 16 years of being wrongfully incarcerated. I am innocent and we proved that with the evidence at the Evidentiary Hearing 21 months ago.

The waiting feels endless. No one knows when the waiting will end or when the Magistrate will issue her ruling. All that can be done is to wait and pray.
