MORTGAGE COMPANY IS LITERALLY MAKING OWNER SICK:  Please help TJ Relieve an Impossible Burden of Waning Health, Medical Fees and Battling the Bank

This is an effort to help a friend who has been to hell and back over the last decade. In that time, she’s lost her husband of 12 years in an accident, was diagnosed with CA and had to undergo surgery and followup treatment. Just as she was beginning to get better, she was hit by the first of not one, but three consecutive floods over 18-months. It then took another 4 years to battle local gov’t to get her property repaired.

We all thought she was back on course and finally able to heal and move forward. But, the cumulative effort of all these events took a huge physical and financial toll.  Her business faltered during the time she had to divert to battling her illness AND the local government, and the medical and legal fees mounted.  She applied to modify her mortgage and was told repeatedly she was a good candidate. After 4 more years and constant, repetitive applications, endless submissions of docs and claims they lost paperwork, endless scrutiny of her financial and personal situation, the mortgage company FINALLY offered her the modification she'd technically qualified for 4 years earlier. 

The terms were simple: Make three trial period payments, and the mod would be made permanent. She made the three trial payments. She made a fourth payment, and was prepared to continue making the payments. She waited for the permanent paperwork. But, in yet another chess move in the drag-this-out-until-they-drop game, the mortgage company illegally pulled the mod offer. Mysteriously, a representative at the bank in a position of authority who had originally helped get her mod started – was suddenly pulled off her case.  She appealed the case to Fannie Mae; and one representative, again with authority, agreed it was absurd what she'd been put through.  Again, this person – within weeks – was suddenly pulled off the case.*

DURING ALL OF THIS TIME, her CA returned! And, she's had to undergo additional surgery and exhaustive treatments, and still needs followup.

Her attorney, who promised to go after the mortgage company, mercilessly vaporized, dropped her case and left her to file bankruptcy alone at the 11th hour, just 24 hours before the house was to be sold at Sheriff Sale. The BK was withdrawn - the house is AGAIN up for Sheriff Sale, and time is waning.  She needs to focus on her health, and this roller coaster is taking its toll.

Meanwhile, she's getting harassed by neighbors, gawkers and voyeurs...drivebys at all hours of day and night - from 6 in the morning, to as late as 11.30 at night; an incredible violation of privacy. Most recently, two men recently IGNORED signs, broke through her private fencing and trespassed on her property, looking all through the property and into windows. As it happens, one of the men has been convicted of repetitive sexually deviant behavior!! He told the judge he felt justified, because the house was going to Sheriff Sale.  She had to take them to court.

In the meantime, the government mortgage modification program is due to expire in less than 2 months... (And the banks are waiting: they can drag out the application process to a tortuous 3-6 months, demanding all the same docs they’ve received dozens of times.)

Her home is NOT underwater!!
She was financially prudent and put 40% down on the house when she and her husband bought it 20+ years ago, so that they could manage the monthly payments.

That was before life heaped its multiple tests (floods, legal battles, health and unsavory mortgage practices) on her alone.

She is able to continue making the monthly payments, but because the mortgage company dragged out the process, then wouldn’t honor the mod agreement, they now will not accept the payments toward the balance.

The mortgage principal is less than $55k.  She owes another $30-35k in fees, escrow and variable fees which she will have to come up with. In addition, she has mounting medical bills that she cannot even begin to focus on.

This is the kind of continuous series of nightmares that, many people will assume, must have been brought on themselves.

It is not.

This is a case where the owner has done everything right; followed all the rules.  The problem:  the banks don’t play by the rules: they keep changing the rules to fit their game.

AND THEY ARE WORSENING HER HEALTH SITUATION!

Bottom line: this is her home.
This is what she’s invested in and fought for - for 10 years after the loss of her husband, illness, floods, and bureaucratic nightmares.

This is her private space.
It’s where she needs to feel safe, recharge, and heal.
As we all do –at the end of the day.

Not only has she followed all the rules -
She has battled, and won.
She survived illness, loss and tragedy.

But the stress of this cumulative nightmare has brought serious health issues back. She now needs your help.

The banks prey on people like this. They will NOT do the obvious thing: modify her loan.


A Drop in the Bucket:

What is so painful is that this is an election year. And when one thinks about the amount of money being tossed around at fundraisers, luncheons, dinners, etc. it’s mind-boggling. Supporters can toss away $1000 per plate for the chance to sit at a luncheon with a political candidate… or write a check for $5000 to support their candidate.

When you think about it, just 20 of those people could end this woman’s decade-plus-long nightmare.  (Not to mention the bank CEOs who have retired with their ill-gotten gains.) It could put an end to the stress that is only exacerbating her health condition.

It’s a pipe-dream, but still – you can’t help but think about how easy it is for folks with that kind of money to end someone else’s horrific situation and pain.

In lieu of that pipe-dream, if you can find it within yourself to help on even a small scale – we are trying to raise funds to help her get this mortgage company off her back. They have NO intention of helping her, or modifying a loan. It will cost her another year of legal battles to even attempt to get them to honor their offer, and by then – she will be physically debilitated.

Please help.

Please help her save the home that she and her husband worked on together to get to this point.  Please help send a message to these banks...who have brought the global financial crises down on our heads, then were slapped on the wrist for their crimes – only to reinvent a new game-plan. The damages they have caused are colossal. The numbers of families they have uprooted, lives disrupted, lives destroyed is unconscionable.

We’re trying to help ONE person – who is living on borrowed time, with no family support and no safety net - show them that we can survive despite their ugly, financial indifference….

The Myth of the Modification:

Since the initial mortgage crises (particularly for those who did NOT put larger down payments down, and then ended up underwater), the banks have been “slapped on the wrist”, and business moves on as usual. With the focus generally off of their illegal activities, the banks have absolutely NO incentive to modify loans anymore, and are basically dragging out the process – and in some cases, literally - cutting the life line on millions of people that are still in need and actually ELIGIBLE for mods. It’s an exercise in futility. Contrary to popular opinion, the housing collapse and the continuous fallout from their horrid business practices is NOT over… they’re just not being watched as closely as they were 5, even 3 years ago. And it’s wreaking havoc on people’s lives.

Only recently Senator Elizabeth Warren of Massachusetts brought this hideous fraudulent behavior to the forefront again, exposing specific SEC violations, false representation, fraud, including the loan mod issue, etc. by our esteemed banking industries (and named names again released in March of this year), and is urging an investigation into the Dept of Justice's handling of these cases.* (see links)

This mortgage company – together with their attorneys - have exhibited draconian efforts to beat and wear  owners down. The longer it goes on, the more money is made by the attorneys for the bank. They have NO incentive to reach an agreement.
