In 2017, James Fejes Jr., a licensed marijuana cultivator in Alaska, was
charged with transportation of approved marijuana involving an aircraft. Despite having state approval to transport and distribute marijuana, he was given a lifetime revocation of his pilot's license from the FAA. Furthermore, he is now subject to 365 days in jail and $50,000 in civil fines.

This case, being the first of its kind, is setting a debilitating precedent that will affect the entire marijuana industry during its early legal formation. This affects anyone involved with the act or facilitation of transporting legal marijuana via aircraft, private or commercial. Even non pilots can be cited by the FAA. Since they are a civil agency this means you are subject to $50,000 in fines or up to one year in jail without the ability to face a jury of your peers .

What James is flying under:
● FAA 91.19 A +B (a) Except as provided in paragraph (b) of this section, no person may operate a civil aircraft within the United States with knowledge that narcotic drugs, marihuana, and depressant or stimulant drugs or substances as defined in Federal or State statutes are carried in the aircraft.

(b)Paragraph (a) of this section does not apply to any carriage of narcotic drugs, marihuana, and depressant or stimulant drugs or substances authorized by or under any Federal or State statute or by any Federal or State agency.

What the FAA said he was violating:
● 49 U.S. Code § 44710. Revocations of airman certificates for controlled substance violations. (b)Revocation.—
(1) The Administrator of the Federal Aviation Administration shall issue an order revoking an airman certificate issued an individual under section 44703 of this title after the individual is convicted, under a law of the United States or a State related to a controlled substance (except a law related to simple possession of a controlled substance), of an offense punishable by death or imprisonment for more than one year if the Administrator finds that—
(A) an aircraft was used to commit, or facilitate the commission of, the offense; and
(B) the individual served as an airman, or was on the aircraft, in connection with committing, or facilitating the commission of, the offense.
(2) The Administrator shall issue an order revoking an airman certificate issued an individual under section 44703 of this title if the Administrator finds that—
(A) the individual knowingly carried out an activity punishable, under a law of the United States or a State related to a controlled substance (except a law related to simple possession of a controlled substance), by death or imprisonment for more than one year;(B) an aircraft was used to carry out or facilitate the activity; and
(C) the individual served as an airman, or was on the aircraft, in connection with carrying out, or facilitating the carrying out of, the activity.
(3) The Administrator has no authority under paragraph (1) of this subsection to review whether an airman violated a law of the United States or a State related to a controlled substance.

● FAA 49 U.S. Code § 46301. Civil penalties:
(A) The Administrator of the Federal Aviation Administration may impose a penalty on a person (except an individual acting as a pilot, flight engineer, mechanic, or repairman)
The maximum civil penalty the Administrator of the Transportation Security Administration, Administrator of the Federal Aviation Administration, or Board may impose under this subsection is—
(A) $50,000 if the violation was committed by any person before the date of enactment of the Vision 100—Century of Aviation Reauthorization Act;
(B) $400,000 if the violation was committed by a person other than an individual or small business concern on or after that date; or
