Justice for Chips Ahoy

After several prompts to start this page I thought I may as well if it will help lead to prosecution.
I have set this page up to help me get some kind of justice and to see that the people who have ruined mine and my families lives are pulled Into court. 

If you are here reading this then I will assume you are all aware of my situation and what has happened to me recently. 

I certainly do not want any free charity and if the target is reached what ever is left from the court costs I will donate to charity.

I'm not sure how much this case will cost but my sicitors indicate between £5000  £10,000 so I have decided to pitch it in the middle. 

I have been royally shafted by the mega wealthy family that are the owners of my business premises. 

I have a really good case and I will win if I can just get the people in question into court. Because its a civil matter I can not get legal aid etc. 

Once I've sued them, I can claim all my costs back on top which will be enough to reemburse anyone that has been kind enough to donate.

I know first hand how tough life is and I appreciate any help that you can offer however small or big it may be.
Any one who knows me will agree that I am a man of the people. I care about doing the right thing and honesty and I will repay anyone that helps I promise.

My business and all of its contents have been underhandedly stolen from me by the following people. 

 

John David Williams of Llanwrst road, Colwyn Heights, millionaire business owner, full list of his business' below. 

 

Sheryl Hughes of Yerburgh Ave, Colwyn Bay

JD'S Niece and heir to the Jd fortune, ex HSBC manager. 

 

Craig Michaelson of Grove Park, Colwyn Bay. Ex head chef of Hydro Hotel, buyer of Chips Ahoy

 

Richard Crouch of Wynne Davies Estate Agents In Rhos on Sea. Estate agent working with the 3 names above. 

 

I will be campaigning outside their addresses very soon you can mark my words. 

 

These 4 people have colluded together and somehow managed to destroy my life and stick it to me out of sheer greed and anguish towards me, they have illegally evicted me and managed to confiscate all of my machinery and equipment Inside Chips Ahoy at 48 sea view road Colwyn Bay after a sale agreement was already signed and in place with Craig Michaelson. 

 

I don't even know where to begin but please take the time to read this very lengthy post and share it so that it gets noticed far and wide. I need justice and this is only the beginning of my protest.

 

PLEASE DO NOT CAUSE HARM OR SUFFERING TO THESE PEOPLE. That will get me no where, although they deserve to be strung up for what they’ve done this protest will and must be peaceful.

By all means comment and express your opinions but please no threats or violence as I will have to remove those comments.

 

Papers and media outlets will be informed and il be armed with a megaphone outside the owners business’ very soon I just hope this never happens to anyone else. 

 

I’m seeking help and guidance or any kind of assistance possible to help me spread the news so if you can help or know anyone that can then please do get in touch or simply show your support with a like and share, anything will help. 

 

So I set up Chips Ahoy in 2013, after 3 years in the west end location one of my staff members stupidly set fire to the shop and all of my hard work was gone.

 

I was insured, the chinese property owner was not, 3 clauses in my insurance were to do with the fire alarm safety cert, the electrical safety cert and the landlords building Insurance, cut along story short, he had nothing and so I lost everything. With 3 flats above you’d think he’d at least service the alarm system etc.

 

Never ever tailor insurance over the phone, always use a broker. I learnt a very hard but valuable lesson and lost it all.

 

Fast forward 6 weeks and I’m operating at the Sea View Road premises, the then 80 year old wealthy owner JD Williams approached me and explained he had a bad couple of tenants and would I like to take over the shop, naturally I jumped at the chance after just loosing everything.

 

I then proceeded to invest my last pennies to the tune of £45,000 renovating the owners whole building and expanding into his property next door which was an empty unit thus making his entire business much more desirable and rateable. 

The buildings were in a state of disrepair and needed so much doing to them.

I paid for and fitted a brand new commercial kitchen and restaurant area so that this property and business had a chance to do well and recover form it’s previous bad trade. I took all of my clientele from west end and boosted this business considerably.

 

I traded moderately well over the next 3 years until I decided to sell my business to Mr Craig Michaelson partly due to family reasons and personal circumstances. Notices were posted and I bid my farewells to you all asking you to show support to the new owners.

 

This is where it gets interesting.

 

After only a short time on the books with Wynne Davies estate agents in Rhos and a few viewings, I was made an offer and everything was accepted and signed off, so the sale process begins.

It usually takes time for these things to finalise but what has happened to me is something out of the movies.

So I obliged in every step of the buyers requests who used some very inept solicitor who didn’t do things speedily, every request and every demand was met with delay after delay through no fault of my own.

Short of throwing in my son as a sweetener for the deal I provided everything before the offer was even put in but yet demand after demand.

Introduction into the place with free training was provided.

Help in every sense of the word beyond what was needed I gave the buyer.

 

The biggest insult was that Craig Michaelson requested admin rights on my Chips Ahoy Facebook page so that he could advertise for staff and promote his taking over of the business. 

 

Naturally I obliged as part of the sale agreement but since providing him with admin rights he has sneakily removed me and has hijacked my page for him self. This man has not paid for my business or my name yet and I’m still trying to recover my page through facebooks copyright procedures.

 

I called up Richard Crouch of Wynne Davies who was acting on my behalf for constant updates as to the progress to be told it’s all going through albeit with delays the sale was almost finalised.

I’ve signed numerous documents for this man including contracts of sale and the sale price agreement.

He has introduced the buyer with the landlords Sheryl Hughes and John David Williams.

They have all colluded together to evict me and come to their own deal. I have copies of my original lease and the new lease Craig and Sheryl have agreed to. 

 

I’d like to point out that I was Richards client and not Sheryl or John David. 

Very shortly after agreeing to sell my business he was given Sheryl’s and JD’s portfolio of properties in the area. I find this somewhat strange. A deal sweetener maybe.

 

Anyway I thought nothing of it as it seemed the sale was close to finalising. I signed the papers and left the premises on June 8th 2019.

Craig was informed and he said that fitted within his timeline and all was great. He quit his job at the Hydro Hotel in Llandudno and was waiting for the keys.

 

A couple of weeks go buy with no word and then I get phone call saying the old man has been in and put up a notice of eviction and confiscation of my goods notice?????

 

I’d like to point out that this man John David handed his entire empire down to his sons, daughters and niece back in July 2009 via the 7 year give away process and has nothing to do with the affairs of the family except he insists on taking charge still and orders his family on how to conduct their business, 

Sheryl Hughes is the acting landlady to my chip shop and she is the boss.

JD entered the closed premises and put up these false notices giving me 7 days to contact him to retrieve my belongings etc. 

All of this was done by the old man when Sheryl went on holiday for 2 weeks and was unaware of his actions.

 

I made contact and said what are you playing at?

I insisted to take my belongings but he was simply angling for information on the sale as the estate agent wasn’t being forthcoming with info without Sheryl being there.

This is totally unacceptable behaviour by JD Williams.

Nobody absconded and nobody abandoned the property. A sale was agreed and signed so why was he saying I abandoned the property and hadn’t paid rent etc? Falsifying documents and making me look bad to anyone that walked past the shop.

 

The reason for delays this time was because at the last minute Sheryl and JD decide they didn’t want to assign the lease to the land registry and asked Craig to take 2 leases under 7 years each so they didn’t have to.

Assigning the lease to the registry protects tenants incase of any wrong doing or liquidation etc and compensates tenants.

They didn’t do this with my 10 year lease either.

 

So back on track we go, I forgave JD’s actions and just asked for updates and calls from himself to me and to the estate agent Richard.

I called up on Monday 5th August to be told that not only has the offer been reduced due to loss of goodwill and the delays caused, that the offer from Craig was actually pulled completely????????

Nothing more to say just that the offer was gone. I will post all the pictures and video I have of Craig the buyer working on my shop on the same day he apparently pulled out of the sale completely, he has been working on my shop daily since then and continues to make changes and prepare to open for trade very soon.

 

Basically at this point I know I’ve been stiffed, I’d heard horror stories about JD in the past and chose to give him credit but after what they've collectively done to me and my baby boy with another on the way in 7 weeks time, I will not roll over and be treated like this.

How dare they think it’s ok to steal someones livelihood like they have mine.

 

They have left me and my son sleeping on my dads front room floor with nothing between us to move forward. We have been left pot-less due to the actions of these people.

 

I will fight for justice until the end, they can pay for what they have taken from me. Probably how they made their fortune by taking it from other hard working people.

A list of all the business' this family own or have interests in will also be posted below and I will campaign for what is right.

 

My lease still stands, they have acted fraudulently and I’ve received no paperwork from any bailiffs or any eviction notices? Not even a call. All JD’s doing and Sheryl not taking charge. It’s not ok to show wilful blindness in legal matters.  

l still have keys and I still own this lease and all of the contents inside the building even though craig is in there now making changes.

 

I reminded them of the interference of goods act 1977 and torts law but they seem to think they are still in the right in what they’ve done.

They switched solicitors to someone in Rhyl last minute and have probably misinformed them in order to get what they want. I will be informing the legal ombudsmen of the situation. 

 

Police won’t help as it’s a civil matter so this is my only option, to start a movement and try and cost the families and business that they own as much as possible by asking you all to help share this like you would a missing person's post and do anything you can that will help publicly name and shame these people for their actions.

 

When I retrieved my paperwork form Richard at Wynne Davies i noticed that my lease has been tampered with. He has yet to provide me with everything and seems to think the offer was only verbal, so I signed a crisp packet then hey?

 

The signature page at the back of my lease has been photocopied and mine and John David Williams signatures removed. It was then reattached blank but I managed to get hold of both prints that they've made!!!!!

I will post a picture below. I have the original and the one they blanked off.

They actually doctored my lease to show no signatures??????? Criminals.

 

I’ve not even finished yet! On Monday 5th August when I was told the news by Richard I instantly called up Sheryl to tell her. 

Now considering there was £20,000 in disbursements due to her she didn’t sound to shocked at the news Craig had pulled out! That’s because they already had their own underhanded deal going on. 

 

Her response came as a wonder to me! After I mentioned the news she simply replied “about that Phillip, we need to have a meeting about this.”

Obviously I’m not stupid and knew something was going on here.

“When do you want to meet?” Thursday 8th Aug before 2pm was agreed. The whole time Craig has been snapped working, ordering signs, changing phone numbers, applying for staff, ordering card machines etc. A lot of work for someone who’s pulled out of the sale.

I asked Sheryl should I seek some legal advise beforehand as I've seen him working in the shop to which she replied “well don’t do that just yet and we will see what we what we can sort out.”

Again my alarm bells started ringing. What did she want to sort out?

 

Maybe they wanted to pay me off a silly amount and make me go away like a good little boy, they’ve done this before and paid one of their previous tenants to leave and he set up shop not so far away.

This family think cash can get them anything and so far it has but I hope to god I can cost them more than they've cost me in lost revenues, they will soon get bored of seeing me protesting outside their homes and business' but I will never give up. 

 

Wednesday night 7th Aug I receive a message from Sheryl saying she can’t meet as she has to be available for the gas board because they have removed the meter due to outstanding debts. 

Yes there is debts associated with my name and the utilities but this would have been cleared upon receipt of payment for the business which should have been long before they took the meter, and before the new tenant entered. Because this has happened they are pinning their hopes on the eviction and saying I owe them money when I do not, I owe the utilities not them. 

 

Her reasoning for confiscating my goods and illegally evicting me is in leu of the debts outstanding! They can not do that! No loan agreement was signed for repayment of anything they have paid for now or for anything they contributed towards at any point during my tenancy and they are now saying that they can’t meet me and I am to contact their solicitor they’ve just started using half way through all of this.

 

Between them all they have managed to stick it to me well and truly and in one sneaky move take away my life and any chance of a future for my family and my baby that's due in just 7 weeks time.

I know John David is the hitler in all of this and he thrives on bullying with his wealth.

 

I’ve spent time with very good solicitors and I have a strong case against them all I simply just can not afford the costs to get them into a courtroom but that won’t stop me.

 

I’ve lost everything I worked for again and this time at the hands of a very wealthy family. I’m broke now and they’re sat laughing at me. 

They shouldn’t be allowed to get away with this.

 

I’m asking as a community for your help.

If you’ve ever eaten at my chip shop and are part of the Chips Ahoy family or even if your just reading this and feel for me in the slightest then please don’t just close this page. 

Spread the word and help me fight for justice for me and my sons.

Everything I built and worked tirelessly for is gone and the buyer I found has gained my business for nothing. 

 

All I wanted was a fair exit, I was already taking a massive hit and virtually giving the business I’d built up such a good following for away.

I did everything right and I’m still so confused and hurt over how they could consciously do this to me.

I was due x amount for the business, minus what was owed as disbursements for debts which would have left me with just enough to clear my name and start over again. Instead of being fair they have tried to be clever and steal my life’s work and kick me to the kirb.

 

I promised the old man I would campaign outside the chippy and I will. I promised he would never rent it again, il be there day and night until I'm paid what is owed to me. 

 

His response was "il just turn it into a house." well go on then get cracking it will cost you a pretty penny and I will watch every step of the way.

This is the type of people we are dealing with, rich and heartless.

 

From this day forward I plead with you, I urge you as a community to show me your support.

There are other buildings and business' these people own but they have nice people trying to make an honest living in them so I won't bring them location's into this but believe me they have so many places it makes me sick to think they should be allowed to get away with this.

I will happilly sit in a police cell for as long as I have to.

I will get out and start all over again as long as it keeps costing them i will never give up seeking justice and compensation for their actions.

My life has been ruined by the richer elite and yet I'm still a fighter, positive of a bright future for me and my children. I fight for what is right and I've never had the displeasure of meeting such a cold calculated family before in my life and I want you all to be very weary of doing business with this family and lining their pockets. Free will is yours I just ask you don't support these companies. 

 

U can't keep a winner down, I will rally on regardless and fight for as long as it takes.
