So far we have covered almost $4000 in fees for immigration attorneys for Jose Villalta, but his case is complex and more fees are due. We have overspent our GFM account by $1500 and there are more costs for us to bear.
Jose came to the US in search of asylum. He was being tormented by both the gangs and the police in Guatemala. The tools of his trade were stolen from him and he was seriously injured in a beating. In 2007 Jose established a life here in the US. He worked construction, he worked at grounds maintenance. He dutifully paid his income taxes every year from 2010 until his arrest and detention. He is married to a legal permanent resident and is the father of six U.S. citizen and resident children.
Since Jose’s detention in December 2018, his family has suffered tremendously. They have been evicted from their Wimberley home and forced to relocate to a dangerous neighborhood in another city. All the children lack friends at their new schools, and both Jose’s wife and older daughter have been hospitalized for stress-related issues. And without Jose’s income, it is increasingly difficult to cover their basic needs.
Jose is a good man with a strong asylum case. He is also a brave man with an even more compelling U Visa case.
The U visa is a United States nonimmigrant visa which is set aside for victims of crimes who have suffered substantial mental or physical abuse while in the U.S. and who are willing to assist law enforcement and government officials in the investigation or prosecution of the criminal activity.

Mr. Villalta Monterroso was the victim of a workplace shooting in 2014, and he acted at gr at personal risk to stop the shooter. He has also served as a witness to the police and the district attorney during the investigation and prosecution of the shooter. We submitted the application today, July 29, 2016, and it should arrive to the Vermont Service Center by Monday, August 1, 2016 at the latest. On my client's behalf, I respectfully request that you do not detain him for any immigration purpose as he is in the process to apply for his U visa.
Right now, Jose’s immigration attorney is working on three legal fronts to free him. She is pursuing his asylum case, his U Visa, and his Request for Cancellation of Deportation. She wants him out of detention. She wants to free him from the dismal lock up in Pearsall, TX. She wants him to be able to get a work permit and go back to supporting his family. She is fighting on every front to free him. But this kind of legal assistance costs money.
