Town of New Haven - Stop the Plant

In January of 2021, the Town of New Haven, NY received an application to develop a cement mixing plant in the middle of a residential neighborhood.  The application came from an individual that does not reside within our town. The applicant has disregarded the town process and has already erected the plant without approvals or permits.  It is evident that he does not care about the impact this industrial facility will have on the families and homes that are around the proposed site.  

Residents concerns are:
Illegal development per 2001 Local Law #2: Site Plan Regulations of The Town of New Haven (quoted below)
Watershed impacts on adjacent wetlands
Environmental impacts due to on-site spills (Applicant has already been reported to NYSDEC for fuel oil spill into an adjacent ditch)
Noise transmission from heavy industrial equipment
Dust and fumes from on-site activity
Traffic impact due to 100+ trucks delivering and returning to the site daily (6-days a week)

The local residents have voiced their concerns and cited local laws that prohibit the development of industrial plants within the Town. Even with all of this opposition the Town Board still refuses to act on our behalf. The town residents are requesting assistance to hold the Town Board accountable. They each took an oath to represent the interest of the residents.  Please help us seek legal counsel so we can prevent this plant from continuing to operate.

The money raised will allow the local residents to continue to seek legal advice and to take action with our attorney (Barclay Damon, LLP). Many of the residents have already contributed but we still need more to continue the fight. Today this is impacting the neighborhood on Darrow Rd, but tomorrow it can happen to any other neighborhood on any other road.  




2001 LOCAL LAW #2: SITE PLAN REGULATIONS OF THE TOWN OF NEW HAVEN

SECTION 5.00 – PURPOSE

This section provides additional information regarding criteria for specific developments or uses,
which present special design considerations.

SECTION 5.10 - GENERAL STANDARDS

The following general standards are hereby adopted for the control of uses for any commercial
and industrial uses, and no such use shall be expanded, permitted, established, maintained or
conducted which shall be likely to cause:

A.      Excessive smoke, fumes, gas, dust, odor or any other atmospheric pollutant beyond
the boundaries of the lot whereon such use is located. Smoke is excessive when the
shade or appearance of such smoke is darker than No. 2 on the Ringleman Smoke
Chart, published by the US Bureau of Mines.

B.      Noise, perceptible beyond the boundaries of the lot occupied by such use causing the
same.

C.      Any pollution or discharge of any waste material whatsoever into any watercourse,
open ditch or land surface.

D.      Discharge of any waste material whatsoever into any sanitary disposal system or
sewage system, except only in accordance with the rules and under the control of the
public health authorities or public body controlling such sewage system. Any
chemical or industrial waste, which places undue loads, as determined by the Town of
New Haven or Oswego County Health Department, shall not be discharged into any
municipal system and must be treated by the commercial or industrial use.

E.       Storage or stocking of any waste materials that will be hazardous to the health, safety
and welfare of the community without appropriate safeguards in place, as determined
by the Planning Board.

F.       Glare or vibration perceptible beyond the lot lines whereon such use is conducted.

G.      Hazard to person or property by reason of fire, explosion, radiation or other cause.

H.      Any other nuisance harmful to persons or property.
