Tenants vs Mint Urban Infinity & Cardinal Group
As of September 30, 2021, I, Brandon Smith, have filed a class action lawsuit on against Cardinal Group Properties and Mint Urban Infinity for violating Colorado's Warranty of Habitability and subjecting its tenants to unlivable conditions that endanger our health and safety.
Our families, friends, and neighbors have shared incontrovertible evidence of unlivable conditions - cockroaches, bedbugs, lack of air conditioning, sewage backing up into apartments, mold and water leaks, missing parts of ceilings, and incomplete maintenance requests. To make matters worse, they charge an outrageous 2-month fee to move out, which forces most low-income tenants to stay here despite the uninhabitable conditions
After numerous emails, calls, in-person visits and maintenance requests, I felt I had no other choice than to seek legal representation on behalf of all current and former tenants at Mint. Carindal/Mint has refused mediation multiple times with a legal mediator and their attorneys have rejected my claims of violating the Warranty of Habitability and any wrongdoing.
We are paying a slumlord who is not taking care of where we, and our families, live, work and play, which endangers our health and safety. I believe the landlord is grossly negligent in their duties and have failed us in every way. So we will make them pay for their neglect in court.
I'm fundraising to cover legal fees as my neighbor Kristin Jones and I put into this (I can show receipts from law firms upon request).
