These deer don’t know it, but the property they call home is being turned into an event venue. The property they traverse every day and night will be filled with large groups of people listening to loud music. The non-resident property owner of these 30 acres in a zoned residential area of Mills River, NC is trying to circumvent the laws for his own gain. The main house, barn, and event spaces are less than 300 ft from adjacent property owners who have already experienced multiple disruptions to their peaceful living from parties held by people who the property owner says are his friends and family. We, the neighbors of 14 properties, who wish to keep our area peaceful are asking for your support.
In August 2020, we were blindsided by a notice of a hearing to be held to grant a conditional use permit for a camp on the property next to our neighborhood. We were denied an opportunity to speak on our behalf. The owner was granted a conditional use permit by the Board of Adjustment in a quasi-judicial hearing. We, the adjacent property owners, had to secure an attorney to fight for our rights. Now, over $10,000 later, via our legal petition to the county courts, the initial ruling/permit is being thrown out because it was agreed our rights were indeed violated.
But this is not the end! The property owner will have a new hearing. In the new hearing, we can speak on our behalf but will have to have expert testimony, such as that from engineers, to prove our case. We will also have to continue to be represented by legal counsel. This means potentially we are looking at an additional $40,000 of expenses. The new hearing will be before the end of May, so we need these funds by the beginning of April.
We are still trying to get our heads around the fact that, in order to protect our rights as citizens in the small town of Mills River, we will have to spend more than many of us make in a year. We have spent many sleepless nights and a given up personal time to address this threat to our peaceful living environment, Any support you can give, either monetarily or as an expert, would be greatly appreciated.
