Stop the Placement of Sexually Violent Predators

Imagine a sexually violent predator allowed by a court to live next to you and your family.  A man who has been convicted in four separate cases including child molestation, annoying a child and lewd or lascivious acts upon a child under the age of fourteen.   A man whose violent sexual offenses date back to 1979. His offenses are so egregious that he's been in state hospital custody since 2004. What would you do? How would you fight it? Do you have the money to hire an attorney?

Our goal is to raise money to start a nonprofit to help communities that need legal services to fight such an injustice. We are uniquely qualified to speak about this need.  Our community has been thrust headfirst into this battle ourselves. The tales to come of how our community has fought to overcome this obstacle is no small feat. It took countless hours of donated time, research, and a bit of luck.

We are the third community, in as many weeks, to go through this fight, and each community has had its unique challenges. Today our community, like so many others, went to court to fight the placement of a sexually violent predator within our community. We spent countless hours without legal assistance to build a case that the judge could not ignore. Sadly, of the 20 people who wanted their voices heard, the judge silenced us by only allowing 4 to speak to the court.

Fortunately, the court heard our most significant legal challenge after hours of delays and grandstanding by Liberty Healthcare. Therefore, for the time being, we have successfully delayed the placement of this sexually violent predator. However, we now have until Oct 1st, 2021, to brief the court further on this subject.

Unfortunately, no one in our community is a lawyer. It's imperative to our children and families' safety that we win this fight. Our fight's based on the legal premise that Liberty Healthcare does not have the legal right to access this property.

Access to the proposed property crosses numerous private properties and lacks legal deeded access or a continuous easement to the property. Residents and  property owners have banded together to rescind their rights and have issued letters of no trespass as well. We've asked the judge to require Liberty Healthcare to produce legal deeded access documentation for this property.

Today, we seek legal assistance in this fight due to legal challenges combined with the court's refusal to take the public seriously. Legal representation in court is imperative to assist our communities to stand in the face of courts that hide Liberty Healthcare behind closed doors. This process has opened our eyes to this injustice. We have witnessed firsthand how the public is disregarded in these proceedings. We want to help, not just ourselves, but also future communities with this issue by helping to provide the legal services they deserve.

We will take all funds raised and help communities fight these legal challenges by providing them the legal counsel they require. Initially, this will help our community by ensuring we have proper access to an attorney who can stand for the community's best interests.  Closed backdoor meetings without a legal representative working on behalf of the community, allows Liberty Healthcare to sway the courts decision without opposition.

We will provide assistance to communities on a case-by-case basis. However, we will focus on cases where legal challenges exist. Through our experience, we've seen firsthand how one properly placed legal challenge can change the direction of these proceedings. This change can touch communities across the state and possibly nationwide.
