This is it folks. The last roll of the dice, the final move on the chess board and with it, the fate of Dunsborough foreshore. This time, the local community is coming in HOT with the law potentially on our side to save our foreshore from the 4-storey apartment block approved by JDAP. This decision will be challenged in the Supreme Court and we need YOUR help to get us there!
‘I thought the horse had bolted!’ I hear you say. In a nutshell…no.
While the community, the COB and Dunsborough2030 have exhausted all usual avenues to prevent the development from going ahead at R80 height allowances, it appears another interpretation of clauses in the City’s Planning Scheme by two independent planning lawyers has exposed what they believe to be an error in the JDAP’s decision.
In simple layman terms, the JDAP applied R80 (4-storey height allowance) zoning laws to the development instead of applying City planning scheme clause 4.8.1 which states ‘A person must not erect any building that… contains more than two storeys or exceeds a height of 9 meters where land is within 150 meters of the mean high-water mark and thus, the JDAP applied the wrong rule.
THIS is why the neighbours of the development are off to challenge the JDAP in the Supreme Court and to have the development reduced to appropriate height levels as a result. This will also mean that the threat of future 4 storey buildings along the foreshore will be gone.
Here’s where we need YOU.
We need to raise $20,000 for potential court costs. Dunsborough 2030 has secured a Planning Lawyer who will represent the neighbours (and by extension, our whole community) on a 'no win-no fee' basis' and the neighbours have hired a barrister at their own cost. As a group, we need to raise the cash in the case the appeal is lost and court costs must be paid. The kicker is, if the appeal is successful, YOU can have your money back! As part of our crowdfunding appeal, we will refund anyone who donates to the cause and who nominates to receive their cash back post a victory. Alternatively, you can leave you money in the Operation ‘Save Dunsborough Foreshore’ GoFundMe account for Dunsborough2030 to use for other community battles. Up to you!
