On June 9, 2017, Lexington School District 2 filed a lawsuit against Mr. Wayne McKim alleging harassment because he filed 20 separate Freedom of Information Act requests seeking information about how Brookland-Cayce High School athletics money is used, use of athletic facilities, athletic recruiting, etc... In actuality, Mr. McKim only filed 18 FOIA requests and the District only provided documents for 3 of the requests.

Next, Lexington District 2 placed Mr. McKim on “Trespass Notice” ordering him not to step foot on the grounds of any Lexington District 2 owned property. Finally, Lexington District 2’s attorney sent correspondence to Mr. McKim, wherein he instructed the Superintendent as well as all District 2 employees to have no further contact with Mr. McKim, regardless of the fact, he has 3 children who attend Lexington District 2 schools and his wife is a Lexington District 2 employee.

The Trespass Notice is a direct violation of Mr. McKim’s constitutional rights as a taxpayer.

According to the South Carolina law, Mr. McKim is 100% within his legal right to request and receive these documents. As taxpaying citizens, we should all be extremely concerned with this abuse of power and the harassment/intimidation techniques that appear to be the norm when government entities don’t want to produce documents.

Where does it stop?
Who is being held accountable?
Who will be the next target and for what reason?

Funds are being requested to assist with filing fees, court costs, attorney fees and the production of documents. We fear Lexington District 2 will likely make this a long, drawn out proceeding in a further attempt to force Mr. McKim to drop his inquiry.
