Male Discrimination making Legal History

For the past 30 years discrimination on the basis of gender is a well-known practice in the workplace. Males encountering this type of discrimination is not widely known or accepted because traditionally females have been the victims of it. In today’s work environment more males are facing discrimination on the basis of their gender. Many males feel powerless and not believed because the social/societal norms do not recognize this type of discrimination. To date, there is no legal case set in the Canadian legal system of males being discriminated against on the basis of their gender. Consequently, some employers/companies believe that they can act with immunity and impunity without fear of legal retaliation.

In 2016, a complaint was filed with the Alberta Human Rights Commission (AHRC) on the grounds of discrimination of gender against a placement/employment agency for their practices. The quest of searching for employment in the legal support profession had been ongoing since 2012. Discrimination on the basis of gender was the biggest challenge in the ability to secure employment within this profession. Legal support positions, traditionally been performed by female personnel with many employers wanting this status-quo to remain intact. Placement/employment agencies are often used as a means to bypass employment and human rights statutes currently enacted. This is an industry practice and a systemic practice that should not be tolerated.

In 2018, The AHRC Tribunal published their ruling regarding this grievance. The ruling was not in my favour. Ironically, they acknowledged legal support positions were female-dominated professions and discrimination of gender was apparent with data that proved females occupy over 95% of these roles. This is a clear-cut case of discrimination on the basis of gender.

In November, 2018 paperwork filed with Court of Queen’s Bench of Alberta for a Judicial Review of this issue. The court agrees to hear this matter in February, 2019. To date, there is no legal ruling in Canada with gender discrimination against males. Other countries court systems (Australia and UK) ruled in discriminated cases where males are discriminated against on the basis of their gender. This ruling could set a legal precedent for Canada’s jurisprudence. The landmark case of Brown v. CAF (1988), set the legal precedent for females being discriminated against on the basis of their gender, it’s time that males have their legal case too!
