My name is Erhan Karaturk. I'm a mechanical engineer. I'm married and have three children of the ages 2, 7 and 9.
After working for private companies for eight years within Turkey, I later ran my own company for three years in Turkey.
In May 2019, I was arrested on false charges for being a member of the Gulen Movement, and the pieces of evidence held against me were: having a bank account at Bank Asya, subscriptions of Zaman newspaper and magazine-like Sizinti, staying at Asya Termal Hotel and using an application called Bylock which meant to use for communication. None of these pieces of evidence constitutes a crime, and it's unlawful to arrest someone innocent of committing any crime. After four months in jail, I was released on probation with a sentence of 6 years and three months, and my case went to the High Court. I was fortunate to be released for the period of decision making. Even though I could stay at home during this period, the likelihood of being thrown back to jail was high in polarised Turkey. I stopped believing in the existence of justice and hesitated for my life's safety; I decided to leave Turkey. I did prefer to take the boat in the Eagen sea rather than being in prison for a crime that I did not commit. In November 2019, I travelled to Greece via the Evros river, searching for freedom. My wife and three children had to move into my father in law's home and survive without me as I was the only one working.
I stayed in Greece for ten months. I heard that some Turkish people who accused just like me were kidnapped by the Turkish intelligence service(MIT) from Greece. Fearing that Greece is no longer safe for me, I decided to go to another European country to feel safe. After a few failed attempts, I finally arrived in Italy in August 2020 with a dilapidated boat with 64 other asylum seekers.
At the same time, my wife applied for a Turkish worker visa, also known as Ankara Agreement (ECAA) which allows her to live and work in the UK with her dependants, and they were granted this in September 2020. As soon as she arrives in the UK, she seeks asylum, and they place my wife and three children in a hostel. I wanted to reunite with my family, thus travelled to a few countries and finally went to France. Then in October 2020, I came to the UK in a zodiac boat with 12 other asylum seekers. I sought asylum as soon as I arrived, and they placed me in a hostel in Liverpool.
I was so happy that I would be with my family again. As we are married so my asylum case would be a joint case to my wife's. Things didn't go as I planned last December 2020; I was arrested in an unexpected way on charges of aiding human trafficking. What was cited as the reason was that I used the boat to ride from France to the UK while putting my life at risk. This situation has turned into a strange claim to aid human trafficking. However, I was only a refugee as were 12 other people on the boat, but when the refugee who was supposed to use the boat failed to do so, it was up to me who had a little more knowledge about it as I'm an engineer. Since all the boats crossing were caught by the British Coast Guard, the people who arranged the boat and told us how to go to the opposite shore did not get on the boat. They said, "One of you should use it." I was the most suited to this job of all, and I never thought it would be an element of a crime. Since December 2020, I've been detained at HMP Altcourse prison in Liverpool.
As I do not have an income, the court assigned a solicitor to me via Legal Aid. I now had a solicitor, but I did not even know the name of my solicitor - meeting him only three days before the initial hearing, 25 days after I had been arrested. The letter I received from my solicitor informed me that he would arrange an interpreter for the hearing on the 8th of January. Without a complaint, I attended the hearing. However, unfortunately, the hearing had to be postponed to the end of February as the interpreter, that was initially promised, had not been arranged. Another 45 days lost… within this period, I had the first meeting with the solicitor, which also became the last one: as he failed to follow up our discussions.
He took my statement and told me I would only be asked, "Do you plead guilty or not guilty?". I plead not guilty on the first hearing at the end of February. Then the court ruled that the main hearings would start taking place after the 24th of May and asked for my defence plea to be submitted until the end of March. The solicitor told me that he would arrange another meeting to finalise my statement, but he did not. He prepared a report from the first meeting we had with some date/place errors and presented it to the court without my approval… I requested my Legal Aid solicitor to be changed, but unfortunately, the judge rejected this. With that, the solicitor told me they would not defend me anymore as well. This left me alone to defend myself without a solicitor in a country where I do not even speak the language.
I once again faced an unfair conviction while dreaming of fleeing from unjustness in my country and starting a new life with my family in the UK, where I thought the legal system would be functioning.
My next court date is the 24th of May; until today, my family and I have used all the means possible to use legal aid in funding my defence. Yet, as this was not accepted, I have had to turn to crowdfunding to support my defence.
I am falling into despair. I was running away from the injustice in Turkey, but now I fear I may face it again in the UK too. I will stand trial without a solicitor for such a severe crime like assisting unlawful immigration, and I might be unrightfully charged with imprisonment of up to 14 years.
Neither my family nor myself have any strength left to bear another misfortune. The hearing is on the 24th of May, and the clock is ticking. The only way out is hiring a private solicitor with your help and support.
Please help me receive a fair trial and regain my freedom with the help of solicitor Mr Dean Garrett and barrister Mr Michael Polak whom I trust.
I have trust in the British legal system that despite all the difficulties and obstacles I have faced - justice will prevail.

4 aylık hapis hayatından sonra 6 yıl 3 ay mahkûmiyet kararı ile dosyam üst mahkemeye gönderilirken -şanslı bir şekilde- tahliye edildim. Dosyam üst mahkeme tarafından karara bağlanırken hapiste değil de evimde kalabilecektim ama bu haksız mahkûmiyet kararından sonra adaletin askıya alındığı, can güvenliğimin olmadığı Türkiye’de nasıl kalabilirdim ki? Kasım 2019’da özgürlüğüm ve can güvenliğimi garantilemek için Meriç Nehri üzerinden Yunanistan’a geçtim. Ben Yunanistan’a geçince, başkaca bir gelirleri olmayan eşim ve 3 çocuğum babasının evine yerleşerek hayata tutunmaya çalıştılar…
10 ay boyunca Yunanistan’da kaldım. Bazı kişilerin Türk istihbarat servisi (MIT) tarafından Yunanistan’dan kaçırıldığını öğrenince buranın da güvenli olmadığını anladım ve başka bir Avrupa ülkesine geçmeye karar verdim. Birçok denemeden sonra nihayet Ağustos 2020’de, kırık dökük, yarı çalışır bir mülteci teknesinde 64 kişi ile birlikte İtalya’ya geçmeyi başardım.
Bu arada Eşim, o tarihte Birleşik Krallık ile Türkiye arasında geçerli olan ve Türk vatandaşlarının Birleşik Krallık ‘da iş kurmasına izin veren Ankara anlaşmasına dayanarak vize başvurusunda bulundu ve kabul alarak Eylül 2020’de UK’ye geldi. Uçaktan iner inmez, O da benzer sebeplerle, Gülen hareketine mensubiyetinden dolayı siyasi iltica başvurusu yaptı ve Londra’da bir hostele yerleştirildi. Onlar Birleşik Krallık’a geldiği için ben de birkaç ülke üzerinden Fransa’ya, oradan da içinde 13 kişinin olduğu bir Zodyak bot ile, Ekim 2020’de, UK’ye geçtim ve iltica ettim. Asylum seeker olarak Liverpool’da bir hostele yerleştirildim. Dosyalarımız birleştirilecek, aileme, beni bir yıldır bekleyen eşim ve çocuklarıma kavuşacağım diye beklerken geçen Aralık ayında, hiç beklemediğim bir şekilde, insan kaçaklığına yardım suçlamasıyla tutuklandım. Sebep olarak gösterilen şey Fransa’dan Birleşik Krallık’a canımı tehlikeye atarak binmek zorunda kaldığım botu kullanmış olmamdı. Bu durum insan kaçakçılığına yardım etmek gibi garip bir iddiaya dönüştü. Halbuki ben de bottaki diğer 12 kişi gibi sadece bir mülteciydim ama botu kullanması düşünülen mülteci bunu başaramayınca, bu konuda bir mühendis olarak biraz daha bilgisi olan bana kalmıştı… Karşıya geçen bütün botlar İngiliz Sahil Güvenliği tarafından yakalandığı için, bize botu ayarlayan ve karşı kıyıya nasıl gideceğimizi anlatan insan kaçakçıları bota binmemişlerdi. “İçinizden birisi kullansın” demişlerdi. İçlerinde bu işe en yatkın olan bendim ve bunun bir suç unsuru olacağı aklımın ucuna dahi gelmezdi. Ülkemdeki adaletsizlikten kaçıp hukukun işlediğini düşündüğüm Birleşik Karalık’ta, ailemle yeni bir hayat kurmayı hayal ederken tekrar haksız bir mahkumiyetle karşı karşıya kalmıştım. Aralık’tan beridir Liverpool’daki HMP Altcourse hapishanesinde tutuklu bulunmaktayım.
Herhangi bir gelirim olmadığı için mahkeme “Legal Aid” ile bana bir savunma avukatı atadı. Atadı ama avukatın ismini bile ancak hapse girdikten 25 gün sonra, ilk duruşmaya 3 gün kalasıya gelen mektup ile öğrendim. Mektupta 8 Ocak’ta yapılacak duruşmaya tercüman ayarlayacağını söylüyordu. Buna da şükür deyip duruşmaya çıktım ama maalesef tercüman ayarlanmadığı için duruşma Şubat sonuna erteledi. Gitti 45 gün daha... Neyse, bu süre zarfında Avukat Bey’le ilk (sonradan anlayacaktım ki aynı zamanda tek) görüşmeyi yaptım. İfademi aldı ve ilk duruşmada bana sadece “Suçu kabul ediyor musun? Suçlu mu, yoksa suçsuz mu olarak savunma yapacaksın” diye sorulacağını söyledi. Dediği gibi şubat sonundaki ilk duruşmada suçsuz olduğumu ifade ettim. Bunun üzerine mahkeme esas duruşmaların 24 Mayıs tarihinde başlamasına hükmetti ve resmi savunmamı mart sonuna kadar mahkemeye sunmamı istedi. Avukat Bey, savunmamı son haline getirmek için benimle bir görüşme daha ayarlayacağını söylemişti ama son güne kadar bir görüşme ayarlamadı. Daha önce verdiğim ifadelerden bir savunma hazırlayıp benden onay bile almadan içinde bazı tarih/yer hataları ile birlikte mahkemeye sunmuş… Mahkemeden Legal Aid’in sağladığı avukatın değiştirilmesini talep ettim ama hakim maalesef bu talebimi reddetti ve Legal Aid avukatı da beni savunmayacağını bildirdi.
Artık iyice ümitsizliğe düştüm. Haksız bir şekilde 14 yıla kadar hapis cezasına çarptırılabileceğim, insan kaçakçılığına yardım gibi ciddi bir suçtan mahkeme karşısına çıkacağım ancak bir avukatım bile yok. Adil bir şekilde yargılanacağıma dair inancım Türkiye’de zaten iyice zedelendi. Ne benim ne de ailemin bir başka aksiliği daha kaldıracak gücü kalmadı. Duruşma 24 Mayıs’ta olacak. Vakit iyice daraldı. Geriye kalan tek yol; sizlerin desteğiyle kendime özel bir avukat tutmam. Beni savunabileceğine inandığım ve güvendiğim Avukat Mr. Dean Garrett ve Barrister Mr. Michael Polak yardımıyla adil şekilde yargılanmam ve hürriyetime kavuşmam için lütfen bana yardım edin.
