A Queensland mother has been left voiceless after a sudden brain injury. Instead of recovering at home with her children and close family, she has been caught in a maze of guardianship and legal processes that have stripped her of basic human rights and separated her from those who love her most.

Most devastating of all, she has minimal contact with her children — even though she has always been a loving and safe parent. Her family say she has been confined against her will in a hospital for months — not because of any ongoing medical need, but because authorities continue to delay and withhold decisions about where she should live. She has been denied the chance to fully participate in decisions about where she lives and how she cares for her children. All the while, a perfectly good home is waiting for her with her loving parents and family, who are ready and able to support her recovery. Instead of being allowed to heal in that safe environment, she remains in a hospital ward that she says feels more like a prison — her human rights restricted, her family life disrupted, her wishes ignored, and her history as a victim of domestic abuse disregarded.

Instead of recognising the strong and willing support of her family, a state guardian was appointed following her hospitalisation. Her family are concerned that this decision was influenced by the perspective of her former partner, despite a history of domestic abuse and protections that should have limited his involvement. They believe this has left her further isolated from her children and those who could support her recovery.

“It feels like we’re living inside an exposé you’d see on Australian Story or 60 Minutes — a story you’d expect to watch about the 1980s, when institutions ignored abuse. You think it couldn’t happen today, but sadly for us, it has. We’re trapped in what feels like a horror story, where everyone expects the truth to come out, the bad guys to be exposed and brought to justice. But here, that ending hasn’t come."

This is what systems abuse looks like: when safeguards fail, when abusers are allowed to use official processes to extend their control, and when institutions ignore evidence of harm. Instead of protecting a vulnerable mother, the system itself has become a source of further abuse — keeping her separated from her children and denying her the safety of her family’s home.

We are raising funds to help her family secure the expert reviews and legal support needed to bring her safely home to her children and her parents, who love her dearly. Funds will be used for:

Independent expert reviews — medical and neuropsychological assessments to show her true capacity and needs.

Legal representation — to challenge the guardianship order and restore her right to be supported by her loving family.

Domestic violence proceedings — to ensure protections already in place are enforced and that past abuse is not dismissed or hidden.

Transparency and accountability — documenting systemic failings so that mistakes are corrected, not covered up.

If any compensation or legal costs are ever awarded that cover expenses this fundraiser has already paid for, those amounts will also be donated to charity, so that your contribution directly helps others in similar situations.

This has been an incredibly difficult journey, and her family cannot fight the system without legal help and independent expert reviews — but they simply cannot afford the legal fees, given the complexity of the case.

The great injustice is that if they had money, this situation would never have gone so far. Justice should never be reserved only for those who can afford it — and yet, without support, that is exactly the barrier they face. Still, they refuse to give up, not now, not ever.
