Help with legal fees to enforce DOH Mask Mandate

The Delaware Valley School District has unfortunately found a way to sidestep the Department of Health mandate by allowing parents to opt their children out with only their signature as validation of exemption. This is not concurrent with the point of the mandate and is causing a spike in cases in our schools and community. At present we have amassed 764 positive cases and 4 deaths in our rural county since school started, last year during this same period with a mask mandate in place, social distancing able to be easily instilled in under crowded schools, and no delta… the number was 58. All we ask is that the school district follows the Department of Health mask mandate as it is intended to be followed to keep our kids, their families, and our whole community safe. We have exhausted every other avenue to meet this minimal goal of risk mitigation and now we are seeking to retain legal counsel in hopes that the courts can step in to keep our county safe. Please help us and donate whatever you can, this is likely to be very expensive as the retainer for the lawyer alone is $5,000. The costs after that will likely be much more and this is a heavy fight for a few families to take on alone.  We have already made moves to secure counsel and we are told that if we win in Federal Court, that the money for the court fees is returned to us, so if we win you will be reimbursed for your support.  

We have retained Kenneth Behrend as our lawyer. He has won two other federal cases and has already begun working on ours and is looking to file  in federal court on Monday. That means we can have a mandate as early as next week and get rid of parent signed exemptions. At the very least this will cut back on the amount of kids having to be quarantined. We are assuming the school board will appeal which will of course run up other expenses.
