Duarte Nursery Stands Up

I’m John Duarte. I’m a farmer in California, and I'm in court fighting the federal government over whether farming is a violation of federal law. They want to fine me $8 million just for plowing my own land.

 There are some spots in my field where water stands after a rain. I often don’t plow or plant in those areas, even though they are dry most of the time. But in 2012, I did plow one of these spots about seven inches deep to plant wheat. Regulators hit me with an order to stop, and when I challenged their authority in court, they countersued. Now they are demanding penalties that would wipe me out. They've even threatened to take my home.

So far, one federal court has sided with the government. But I'm determined to continue this fight, because no farmer in America should have to tolerate such an abuse of power. 

 Today, I have a mortgage on 450 acres of California farm land that a court has ordered me not to farm. My legal bills are $1.5 million and growing. And what the courts eventually decide about my own farm will have far-reaching effects on farmers across the nation. 

 The government wants the courts to interpret the law the way the government wishes it was written. Congress wrote the federal Clean Water Act to not regulate normal farming. But now regulators want to use that law against me and other farmers even when our farming does nothing to harm the environment. That flies in the face of everything I believe, as a farmer and as an American.

This isn’t right. Federal regulators want to control ordinary farming. They're starting with me and a few others. We need to stop them before they put more farm families in economic peril--before they make farming a federal offense.

I’m drawing the line right here, in my field.

Over 95% of our wetlands are gone. You destroyed another bit of the last precious few, and you want everyone else to pay you for your arrogance? I hope the government takes you for all you're worth, which like most heavily subsidized farmers is probably millions.

I think you need to write a letter to our new president because he does care, he will investigate! This could cost you the farm! First write to your local governor, then up the chain to head! It can't hurt! Good Luck!

Its obvious the farming, cattle and dairy industry has been under attack for decades now..slowly and systematically destroying family farms making way for corporation farms..HE WHO CONTROLS THE FOOD.THE WATER..CONTROLS THE PEOPLE..Welcome to the New World Order..GLOBALISM...ONE WORLDERS....where fools think the earth is better ran by a handfull ofpeople rather than individuals who are members of their own communities THIS IS A PERFECT EXAMPLE OF MICRO MANAGEMENT BY PEOPLE WHO HAVE NEVER LIVED ON THE LAND THEY TRY TO CONTROL...This is exactly what the REVOLUTION was ABOUT...Americans NOT wanting to be forcefully ran by people from far off lands.such as England...Those who are guilty of destroying the earth, try to blame us for what they have done , then they loot us with taxes and fees to keep us subservient to them..Megalomaniacs...psychopaths...empty hulls ofgodless human flesh.

Corporate farms will not be subjected to this treatment. The whole idea behind this is to destroy individual, independent farmers so their land can be bought at fire sale price or under closed bids put out by the government (means the favored ones will get the property with winning bids and there is no way to find out who bid the highest - Algor did this with the Bakersfield oil property the gov't bankrupted then sold under sealed bid to Algor's family oil company, Occidental and got huge campaign donations). It is big business using well-intentioned laws to run their competition out of business and pick up farmlands on the cheap utilizing elected officials who get huge backsheesh pleasing their masters.

To Janet Thew: Wow, are you misinformed! Wetlands have doubled over the years because of the illegal abuses of agencies like BLM, Forestry Services, etc. They are basically using bogus charges against our farmers, Ranchers & Landowners from California to Texas to Utah and back JUST so they can steal the land from the hard working Americans then resale to FOREIGN COUNTRIES to mine the resources under ground.
