Standing firm to stop the alarming and perilous Benicia Valero Refinery Crude By Rail project.

Description:
The Benicia Valero Refinery has proposed a “crude-by-rail” project for 70,000 barrels per day of “North American crude” (100 rail cars per day). Valero has admitted that this would include North Dakota Bakken crude - responsible for many train derailments and explosions over the last year. Canadian Tar Sand could also become part of this scenario. Because refining extreme crudes creates more pollution than conventional crude and poses devastating safety risks; environmental, health, community organizations along with governmental agencies (such as California Attorney General’s Office) have expressed grave concerns over transporting crude-by-rail. We stand firm to this Stop Crude-By-Rail !

Stop Valero's Oil Trains at the Sept. 20th Benicia City Council Meeting!

It all comes down to this. The Benicia City Council could vote on the proposed crude by rail project at the City Council meeting on Tuesday, September 20th. And, we need you there to make sure they make the right decision.

The threat from Valero’s proposed crude by rail project is too great. In Benicia it means more air pollution, more explosive crude oil, and more traffic -- and, for California, it means putting thousands of people in the oil train blast zone.

It’s been a wild ride on the campaign front. In early February, the Benicia Planning Commission voted to unanimously deny the project. Valero appealed this decision to the Benicia City Council and in April, the City Council voted to delay their vote while Valero appeals to the Federal government on the question of preemption -- whether or not Benicia has the right to say no to oil trains under federal law.

On September 20th, the Benicia City Council will revisit the project and we need to tell them that communities have the right to say no to oil trains.

BREAKING - Re: Valero's CBR Project: CA Atty. General Kamala Harris: letter disagrees with City of Benicia staff, consultants and Valero

Today the City of Benicia received a letter from California Attorney General Kamala Harris disagreeing with City staff, consultants and Valero Refinery.

The letter asserts that Benicia’s Planning Commission and City Council have every right to deny a land permit for Valero’s Proposed Crude by Rail offloading rack.

Significant excerpts:
“For Benicia to turn a blind eye to the most serious of the Project’s environmental impacts, merely because they flow from federally-regulated rail operations, would be contrary to both state and federal law.”

“City Staff has asserted that Benicia is “legally prohibited” from denying the Project based on the rail-related impacts disclosed in the Revised Draft EIR. Valero agrees with City Staff, asserting, ‘the City Council’s hands are, in effect, tied by the law of federal preemption.’

“We disagree that the City is prohibited from considering the Project’s eleven significant and unavoidable rail-related environmental impacts when exercising its local land use authority.

“Where, as here, an oil company proposes a project that is not subject to STB regulation and over which a public agency retains discretionary permitting authority, it would be a prejudicial abuse of discretion for that agency not to consider all of the project’s foreseeable impacts in exercising its authority.

MONDAY 4/4/2016 - LAST TIME FOR PUBLIC COMMENT: Valero has appealed the unanimous decision by the Benicia Planning Commission, to reject Valero's crude by rail project in Benicia. The appeal is now before the City Council and public comment will begin THIS MONDAY.

IMPORTANT: City Council's staff has recommended that it overturn the Planning Commission's decision!! We can't let this happen - it is critical that your voice be heard!!
