In the 2013 General Election for the Cayman Islands, a constitutional challenge was filed by a registered West Bay voter, Mr. Gordon Hewitt, who sought judicial clarity on the eligibility of a political candidate, Tara Rivers.

The Constitutional challenge raised by Mr. Hewitt came after a minimum of four other potential 2013 election candidates were refused permission to register by the Elections Office, although all four who were denied shared similar nationality situations as Ms. Rivers.  

Contrary to the public's anticipated judicial finding, case precedent was not followed in this matter. This decision astounded multiple legal practitioners in the legal community when they learned of the Court's decision, which ruled in favour of Ms. Rivers.

Initially, the Chief Justice refused to grant costs against the constituent for hearing this case.  The Chief Justice  specifically stated that this was a very important case since it was in the public interest to settle the questions on the Constitution which had been raised through this challenge.

Further, the Chief Justice implored the parties involved, which included the Attorney General and the Elections Office, NOT to pursue the legal costs against the constituent, particularly since there was much confusion in the Cayman Islands Constitution which prevented proper guidance from the Elections Office to all interested potential candidates at the time.

However, it was reported in the media last week (10th February, 2016) that legal costs were, in deed, being demanded from the constituent by Tara Rivers to cover her legal costs incurred in this matter. She's asking the Court to grant her the sum in the range of US$140,000.

The call has been made by the ELECTED OFFICIAL to punish this CONSTITUENT by demanding that the Court order the bankruptcy of John Gordon Hewitt for failure to pay this legal bill. 

This Minister's request against her constituents is threatening to potentially make these SENIOR CITIZENS HOMELESS if their marital home and all their assets are dissolved to satisfy this legal bill.

It should be noted that Mr. Hewitt is a Caymanian in good standing in the community and Mrs. Hewitt is a retired Civil Servant on a fixed income. She faithfully served the people and the Government of the Cayman Islands for over 33 years.

Mr. Hewitt was engaging in a constitutionally protected challenge that the law gives to ANY registered voter.

We are looking for true patriots to commit to contributing any amount, to help support this couple who is threatened with loss of their home, equity and assets for daring to bring a constitutional challenge to the Courts.

We are called to assist to right this grave injustice, as it will impact the actions surrounding future electoral questions in this country, and this was specifically pointed out by the Chief Justice.
