HELP ME FIGHT A SLAPP SUIT

A faith healer sued me for criticizing him. This is a SLAPP suit designed to shut me up, but to also scare the rest of you. Do you want your free speech rights limited by this kind of behavior? What about your right to make up your own mind based on both sides of the debate?"

I am trying to raise money so that I don't have to cave in. I'm going to fight this case as hard as I can. But, if I win the case and there is money left over, everything remaining will go to Opportunity Village. 

I think that Miller has defamed me too but I will NOT use any funds for a defamation counterclaim. I believe in the marketplace of ideas. My ideas are stronger than his. He can say whatever he wants about me -- I am not using the courts the way he does. I'm taking the high road.

As of this morning, May 20, Adam Miller withdrew his lawsuit "without prejudice." What that means is that he is still reserving the right to re-file it.

Therefore, while my legal bills are not mounting at the time, we are not out of the woods yet. Remember, anything we don't use, goes Opportunity Village. So I'm still fundraising, but I want everyone to know what is going on.

Could you link to a copy of the actual complaint? I'm a lawyer (not your lawyer, or even an Arizona lawyer), and I'd like to take a closer look at it. If it's a copyright case, and the defendant wins, the defendant can collect attorney's fees. http://www.billboard.com/biz/articles/news/1429304/case-analysis-recovering-defendants-attorneys-fees-in-copyright. I would imagine that you'd easily win with a fair use defense, so I'd be interested in seeing the specific complaint.

Hi Stephanie - Can you edit the start date on this campaign? It lists March 5, when it should be May 5. As a consequence it looks like donations have come in very slowly, which tends to be self-reinforcing.

"An atheist cannot definitively prove there is no God and a Christian cannot definitively prove there is so who cares." Most American Christians use a book written by a bunch of dudes in the English Middle ages to suit King James. I.e. Long after the original text was written down - and before that passed by word of mouth over many centuries. Chinese whispers has nothing on that. The difference is that atheists, as a rule, don't try to prove there isn't a god(s). We do, however, have incalculable amounts of logic and hard science on our side. Atheism as a kick-back against religion is a religion but that's equally illogical. This lady isn't dismissing faith - she's calling out a charlatan and a fraud. It's really that simple.

I don't think you're going to need "expert witnesses." This suit is a non-starter. There's no way a judge is going to call this anything but fair use, unless you've made some video where you just use his videos straight through, without commentary.

You should be able to have this frivolous SLAPP suit thrown out on a demur. There is no prima facia defamation in your video. However if the lawsuit does go to court, it could be used as a precedence case to shut down the SLAPP suits of future swindlers who rip off unsuspected people with real illness and then sue the people who expose them. I wish you luck in winning your fight. We have been trying to raise money for my husband to walk again and can't seem to get the kind of attention that you have drawn, nor the donationd! What I would give to see my awesome man with a smile from ear to ear because he is not serving a life sentence in a wheelchair. Really important to fight against these sorts of SLAPP suits. Anti-SLAPP laws should exist in every state in the US, and every country in the world. Good luck in raising the necessary funds Stephanie, and if there's a counter-suit to be had, go for the jugular! :)
