WE NEED YOUR HELP!! I was recently talking with a customer and it was confirmed that most people believe that we won against the City of Greater Sudbury and will remain open as Sudbury’s only free-range dog facility. I can assure you we have not.
The battle goes on.
For those who do not know the hell this municipality has put us through over the last 3 years, let me explain briefly. This began in December 2016 when we applied for a new building which would house an inside play yard, a hydro-therapy pool for dogs and a full grooming station. The city notified us the beginning of January 2017, that we were not compliant with the distance to 5 neighours (2 neighbours built after the kennel was well established). My building hadn’t moved. The city simply made numerous errors on our license even after numerous inspections prior to opening, and every year since. Then
they notified the neighbours and they started complaining about dog noises. We had very few issues with our
neighbours prior to this (one of their sons even worked for us for a summer). And have had 2 sound engineers reports that spell out that our noise levels are not above provincial standards. Well now three neighbours have started court action against us for $500,000 each. The city is also a plaintiff on those documents. The city claims they made no errors on the business license but during a taped live meeting it was ‘disclosed’ via a city official that errors were made.
On our council meeting of November 20, 2018, the council ask the city to look at changing the bylaw. A very simple fix. The city decided against that and used the example of the municipality of Amherstburg in southern Ontario. Their bylaw is 2000’ from the nearest neighbour. Sudbury is 1000’. Sounds like a good example for the city to use. After all, they been working against me this whole time. But if you google kennels in that area you can see on a map, that Countryside Kennel has numerous houses within 1000’ of that kennel let alone 2000’. They must have been rezoned to be able to run a kennel there. That is all we were asking for. After all, the error is on the part of the city, not me. So when they close my business, I’m hundreds of thousands of dollars out of pocket, all because of their error.
To compound things, the City has numerous other pet businesses that do not meet the same bylaw but they are
not harassing them at all. I’ve been told that the city has rules in place that they can enforce bylaws on one business but on a similar one, with the exact same problem, the can just let it ride. So my business has be singled out and harassed to meet numerous other qualifications but not the other numerous other pet business in the same area, who have the same exact issue.
Well, this has cost us a huge financial
burden of well over $20,000 to date and the legal fees are just beginning. So I am putting it out there plainly for everyone to see. I’m frustrated and getting tired of fighting this battle. So......

OUR NEXT MEETING WITH THE CITY COUNCIL IS EARLY JULY 2020. THIS IS WHEN THE FINAL DECISION IS SUPPOSED TO BE MADE.
