Marcus Soares (8th Degree Red and White belt), a well decorated martial artist and world class instructor, was a direct student of Grand Master Carlson Gracie, and part of the first generation of the Carlson Gracie team that was formed in 1970’s. He has been studying the art for nearly 50 years and is widely referred to as “the encyclopedia of Brazilian Jiu-Jitsu” in Canada, as well as the first official black belt to open a Brazilian Jiu-Jitsu (BJJ) academy in Canada.
Having dedicated his life to the art of BJJ, competing and training many champions, he is now the victim of an unethical and unfounded civil law suit from a former student named Joe Peters (36 years old). Joe Peters is suing his former instructor for alleged injury he claims to have acquired during a BJJ competition. Peters is seeking general damages for pain and suffering, lost wages and future capacity to earn wages.
The lawyers for Marcus Soares (the coach) tried to have the civil case thrown out, pointing out that Peters has signed 2 waivers, however the Supreme Court of Canada judge ruled that the waiver signed by Peters before his training did not extend to competition, therefore the case could not be thrown out.
Master Marcus Soares has already suffered a significant amount of legal fees (in the tens of thousands of dollars), while trying unsuccessfully to have the lawsuit dismissed.
As students, friends and supporters of Marcus Soares we are trying to raise funds to help ease the financial burden imposed on a great man, with the goal of helping Marcus succeed in defending himself so that we may also set a precedent, as to avoid any future possible cases of similar fashion from occurring again in Canada.
