When a Water Drop Becomes a Teardrop

We are a family of four and in August 2010 we left Germany and moved to Salmon Arm, BC, Canada and this is our story.

It became our dream to move to Canada after having visited and witnessed the great natural beauty of the country and experienced the warmth of the people. We prepared ourselves for the immigration process; one of many big steps was the selling of our farm in Germany and finding a new home in Canada.

In the spring of 2010, Norbert and I flew to British Columbia from Germany and with the assistance of a realtor; we viewed several rural properties near Salmon Arm and immediately fell in love with the Larch Hills area. Norbert spoke no English and my command of the language was weak so we were introduced to an established local realtor who was fluent in both English and German. The property that captured our hearts, with its European-style house and acreage for horses meant that Norbert could continue in the near future his trade as a farrier. We could see our family happily settled here.

Accompanied by our real estate agent, we viewed the property extensively and spoke at length with the owners (an elderly married couple, who by chance happened to be fluent in German, as they had moved from Germany to Canada years earlier) and their real estate agent (she spoke English only). Our realtor translated what the other realtor had to say. The owners spoke German to us and also translated to the English speaking realtor.  We were informed that the existing drilled well on the property were we are interested in did not provide enough water so for years additional water was being piped over from a well situated on land adjacent to the property in which we were interested. As both properties were owned by the same people, we expressed our concern to the owners and the realtors that the water supply was secure and received assurances from them that the primary water source was dependable and would at all times provide an adequate supply of water. We trusted them all.

Norbert and I flew back to Germany and prepared our children and two dogs for the big changes to come. We started the immigration process; one of many big steps was the selling of our farm in Germany. With the sale we arranged for a down payment and a mortgage to purchase the property in Canada. Once that was straightened out and with our things packed we arrived at our new home in August 2010. Though a rough start, we settled in. We got our beloved animals (horses, alpacas and cats) and Norbert started his farrier business as well as working full time at another job. I found work and the children settled into school. Of course, we miss family and friends back in Germany but we were making new friends here, in Canada, including our neighbours (the former owners of our property). We saw them often and helped them when they needed us; they called us family which made what happened next so unbelievable.

In July 2015 a lot changed. The former owners let us know that they would be selling their property (which incidentally only housed a shop, they don’t live there) next to ours and that we would have to find a new source of water. We became confused and then concerned when we contacted the Regional District North Okanagan (RDNO) only to learn that our shared water source was not a well but instead a creek and that the former owners had no water license. We spoke to the former owners again and suggested that we could apply for the water license and incur all of the costs and that they would only have to grant us an easement. They behaved stubbornly and refused to provide us with an easement (access) for water. We decided there was no other option but to consult with a lawyer.

In the meantime, we received a letter from the former owners threatening to shut off our water source to intimidate and scare us. In October 2015 they shut off our water source. We found ourselves stranded – a family of four and our eight animals and no access to water.

We had no other choice but to go to great expense to hire a drilling company to find water on our property. After tens of thousands of dollars and several attempts, the holes came up dry. We became so financially stretched that we could not pay the drilling company. The drilling company has filed a lien against the title to our property in order to secure its right to recover the outstanding drilling costs.

We proceeded with the lawyer to find a solution with the former owners but to no avail. To date, we have expended thousands of dollars in legal fees and are at the discovery for examination stage but we are unable to financially continue the legal process. My family greatly needs your help to Fight For Justice because we have been deceived from the beginning by all of them, the former owners and the realtors involved, believing what they told us; not thinking that Norbert and I had to investigate to confirm what they were telling us true specifically regarding the “existing” well. We had no idea about water licenses and easements. We hired a real estate agent to make sure that all the information provided was factual and correct and followed Canadian law. They were paid very well but failed us miserably. In addition, our bank approved our mortgage without due diligence. Their appraiser mentioned that a well water certificate was required for the property but they granted the mortgage without the necessary well water certificate! The former owners, the realtors involved, the notary and our bank misrepresented themselves throughout this whole process and now our family risks losing our home and everything we have worked for our entire lives.

This is a very stressful journey for us. Please be aware… it does not matter who you are or where you come from, this experience can happen to anybody. This is also an appeal to the public from our family to yours to help us ensure that there is justice and accountability. Norbert and I and our children are now at risk of losing our home simply because of others who mislead and misrepresented the facts. With your financial support, we hope we can continue the legal process and make things right.
